  • grandson owes money to the tax man.

    My grandson lives with me, for the time being and I have recently noted that he has an outstanding bill with the tax man obviously this has not been paid. He had an unpaid fine which was chased by a company called Marstons, who stated they are entitled to take my property as well,I paid this fine,
    Now I am a bit worried about this second bill, although nothing has come through the post yet. Are these people (bailiffs) entitled to take my property for my grandsons debt, just because he lives with me.

    Your grandson needs to engage with HMRC and sort out the outstanding tax bill asap.

    Are you saying that the fine has already been paid? If so, it is possible that a distress warrant has been wrongly-issued.

      thanks for your answer, no the tax bill has not been paid. I don't think he has done anything about it as yet, he has been told to get in touch with them.

        My experience of HMRC is that they are reasonable people as long as you don't mess them about or try to pull the wool over their eyes.

        Could you list what your grandson is being chased for, please?

          Thanks you I will get to get in touch with HMRC and sort something out before we get any threatening letters.
          He was being chased for a fine, but I paid that for him as Marstons said they were coming to remove his property and were taking mine as well if I did not have any receipts for the goods , so I paid the fine.

            Marstons were misrepresenting their powers which is serious. Your case is one of a number of such cases that have come onto the LB forums in the last two days.

            The threatening letter from Marstons wasn't signed by a bailiff called McGovern by any chance? What you describe is his modus operandi.

              You could reclaim the bailiff fees, as you were not the debtor but armed with your new knowledge you can complain to HMCS regarding their bailiffs misrepresentations.

                  HMRC are a different bkettle of fish when chasing debts owed to them and it is important he gets in touch with them.

                  First line of attack from them is to write to you but invariably it is difficult to ascertain what or when the debt relates to. They usually start adding fees and/or interest to what is owing.
                  .
                  Next step they may send it to Debt Collectors who will write or visit. Easily dealt with as they can be told to take a hike.

                  Biggest fear is if they take it Court as all they have to do is to produce a Certificate to say the money is due. Doesn't matter what defence you have they automatically win. They also have their own Enforcement Officers who have the right of entry and may force their way in. However they can be talked to and as said he must speak to them before it gets out of hand.

                    Thank you for all this information.
                    The actual bailiffs letter, Bluebottle, stated 'If payment was not made by 7pm that day they would be back tomorrow to remove goods. My grandson phoned them and they told him they would remove anything that I did not have a receipt for. The bailiffs name was Woods. I paid this and have since been looking through the internet to see what rights bailiffs have, what they can take etc.

                      Mr Woods is a liar.

                      He knows - or ruddy well ought to know - that he is only entitled to seize goods belonging to the debtor and that, as your grandson lives with you rather than you living with your grandson, the presumption would be that goods belonged to the householder.

                        Marstons know they cannot remove goods that do not belong to the debtor. That is endorsed on the distress warrant and is a general principle of the law relating to distress. Marstons seem to be under the misguided belief they can do whatever they like without fear of recourse. If only that were true. My advice is to make a formal complaint against Marston Group Limited to the Correspondence, Complaints and Litigation at H.M. Courts and Tribunals Service.

                          thank you for all this information I have copied most of it over 'just in case'. I am in this position again with my grandson. I down loaded a form from the internet. Complaint against a certificated bailiff. Also the original debt was only 120.00 but ended up 420.00. which I thought was way too much. but I am not sure what they are allowed to charge. it seems they can do what they want.

                            What form was that? Please be very, very careful and wait for further advice from those on here in the know!
