    Hey,
    I've been reading through all of the other forums regarding how to deal with Jacobs Bailiffs but want to double check before I deal with the council.

    I have received a Bailiff letter from Jacobs - This letter claims I owe £1246.15 +1 account - when double checked via the councils payment place that claimed - £938.00. Jacobs letter gives me 48 hours to make payment in full or "I will re-attend your premises and may REMOVE goods even in your absence.

    I have sent two letters to Jacobs, the first in November offering a payment plan that I could afford, they refused it. I sent another letter, detailing my circumstances, a full time uni student (24 years old), with no income and as yet still no student finance, and offered them the same payment plan - no response till the letter detailed above.

    On receipt of the letter, i.e last night I text the bailiff as speed was of the essence and I needed evidence of communication in writing and they do not give their bailiffs e-mail apparently, detailing my payment plan as being all I could afford. His words "No sorry, removal warrant Wednesday unless clear" I informed him that the advice from all debt situations is to pay by instalments within my financial capability and that's what I'm offering. To be honest, I have nothing of value in my house, apart from a really old tv, a broken mobile and a laptop I got for Christmas to help me with Uni work. I do have lots of art materials though.

    Is there anything I really should be doing at this stage, do I wait it out, try and persuade the council to take back the debt and I pay them?!

    First of all. please try not to panic. Bailiffs thrive on people panicking - think of them as being somewhat akin to dementors. It's also unwise to kiss a bailiff. :nerd:

    Have you let the bugger into your home - and why?

    Did any bailiff take down an inventory of goods he planned to seize?

    Do you own a motor-car and has the oaf seized that? (If he did, he should have left a Form 7 Notice of Seizure with the details on it.)

    How many visits have the bästärd bailiffs made?

      You need to speak to someone at the Council and ask the following questions:
      1 - how many Liability Orders they have against you
      2 - the dates they were obtained
      3 - the addresses they were for
      4 - the period of time each covers
      5 - how much each one was for
      6 - how much is still outstanding
      7 - the dates they were passed on for enforcement
      8 - the dates & amounts of any payments

        You can by[pass the Bailiff by making payment direct to the Council via online banking, Council website etc but if a student then surely you are exempt anyway!

          Thanks all so much for replying - you do a great job helping us all out.

          I have no car, and I haven't let them in at all. Luckily I've been at Uni so I haven't even been here.

          Since my letter in November detailing payment plans that they couldn't be bothered to reply too, this is the first letter I have had.

              I rather suspected that.

              The level of fees that the buggers are trying to claim suggest that they have seized - or levied, or tried to seize or to levy - any motor-car near to your home, then added "removal costs" by way of front-loading "potential fees".

                The council are refusing to do anything. They are saying they can't recall the debt or do anything about it at all.

                There could be a slight situation where the council have incorrectly billed me from the 1st September to the 16th of September but this needs to go in writing to the council, So doesn't help with the bailiffs turning up tomorrow.

                The amount I owe is £935.41 but I have paid £40.00 of this.

                    If the bailiff has not been in, he has no levy, all he can have is a visit fee. If you have a car hide it Jacobs WILL clamp any car near your property whether you own it or not. You do not have to let him in whatever he claims.

                        that will get the breakdown, you could phone them and tell them you don't own a car and see what they say, but you should record the call as Bailiffs LIE

                          Obviously you have a Council that have forgotten their responsibilities. They can recall the debt - as it is theirs in the first place - but choose not to. As for the informataion I suggested you get from them they are obliged to provide that. Who did you speak you?

                            Let us be kind to those morons and say that they are grossly mistaken.

                            For example, Eric "pie eater" Pickles says that they can recall debts and he's perfectly correct - they can!

                              They did give me all the information I asked for, but said the simple fact that I can't afford what the bailiffs are asking for means that they can't recall it - they can only recall it if the debt was given to the bailiffs incorrectly which they claim - it wasn't.
