    Default on walking possession

    Hi I wondered if anyone could advise what is about to come our way.

    Back in January 2013 I signed a Walking processions order thing for council tax arrears. The goods are our red fabric sofa, arm chair and the foot stool.

    Unfortunately we defaulted on our payment in December, usual reasons I.e Christmas, family, kids etc.

    They are now passing this to their bailiff tomorrow and require a full payment of £254. We simply do not have this at this given time, but my student finance will be coming in the 23rd which was going to pay off the debt in total (and two others through the same bailiff)

    Should I allows them to take the sofas etc? I don't want them too as with two kids aged 5 and 2 it might be a bit upsetting and I don't believe they can take them as they are needed. Is that right?

    I completely understand its our fault and I'll happily just accept what is expected but I'd just like a little hinde sight if anyone can provide?

    If it makes any difference the bailiff is Chandlers.

    Haha yes bailiffs but also the finding out all these mysterious visits and charges :/

    I know we haven't had a visit we where in all day. As my partner works nights and we'd been at my mums the day before for new years. I have emailed Simon and the councillor with my concerns.

    That explains it - Crapita are quite notorious for buggering up almost everything they handle.

    Perhaps Chandlers - who one might reasonably suppose to be some economical with the actualit
    é - have stated that a visit has been made when it actually hasn't?

    Does that mean the fees are removed?? :/
    No, it doesn't.

    What it means is that Chandlers won't - or shouldn't - try to chase you for any more of their improper, invalid or unlawful fees, but those you have already given to Chandlers will remain with Chandlers, in keeping with the First Rule of Acquisition. (link)

    With regard to the bailiff fees that have been charges which are listed above as a result of the accounts being recalled from Chandlers Bailiffs the balance of the fees charges will have been written off by Chandlers and are therefore no longer payable.

    I can confirm that all of the accounts have been recalled from Chandlers Bailiffs and an attachment of earnings order has been issued to your employers to have deductions made directly from your earnings.
    I would urge you to settle the remaining balance owed on your former account at 4 Street to avoid an attachment of earnings order being set on this balance in the future.

    I also attach here with a direct debit mandate for you to print and return so that your future liability can be collected directly from your bank account and avoid the need for any future recovery action being taken.

    With regards to the other queries that were raised during our telephone conversation I must advise that these are currently being investigated with Chandlers Bailiffs and as soon as I have a response from them regarding these matters I will be in contact with you again.

    Why not suggest your Councillors look both here and CAG to see the types of shennigans that Bailiffs get up to. They will soon see that 1 firm is very much the same as another and very few if any can be trusted.

    Remind them that it is their duty to keep an eye on these things, and if it is systemic as it appears to be , and Chandlers are actually engaged in criminal actions aka fee fraud they should stamp it out and haul their revenue officials over the coals. Also remind them that it makes the councils image look terrible.

    I believe I might politely ask him why nothing seems to have been done to prevent a recurrence of such abuse of the process by bailiffs.

    Go to YouTube and then go to the UK Column channel. The guy who presents UK Column Live, Brian Gerrish, is an authority on Common Purpose. Also, Google "Saul Alinsky - Rules for Radicals". Alinsky was a Marxist agitator and whose creed most of the main political parties in the UK - Tories and Labour especially - seem to have adopted. Read through "Rules for Radicals" and the reasons why everything seems to be going mammaries up will become very clear.
