Hello. Due to miscalculations by HMRC and them not taking into account the changes in circumstances I kept them informed off, they claim I was overpaid @£900 tax credit. This was approx. 3/4 years ago, I had received a few letters from them at the time but I kept telling them I disputed that it was my fault. I heard nothing further but, now I have signed on for JSA, I have received a letter from dlc debt collectors demanding payment in full. I am worried sick. I have no job and no money and don't know what to do. Can someone advise if they will remove property from my house or take me to court? Thank you.

Well it seems like they wanted to help this from a DCA who sent some fool round looking for her I tolgd him she never lived her and I was sick of getting callers and letters for her.
same DCA who I phoned from a phone box to say she lived at the house that we had reposed and that they would lie about her being there but she was.

I have a similar situation, where they claim to have overpaid me £600+ on tax credits. They passed the alleged debt on to Advantis, who were pretty persistent, till I sent a letter of complaint to HMRC and a copy of my complaint to the DCA. They said they'd put my account on hold for 30 days, that was on Nov 18th so the 30 days are over but I've not had a response to my compliant from HMRC. On it, I state that I'll pay them if they can show me the calculations they used to arrive at the figure quoted.
No, they can't remove anything from your house without taking you to court and obtaining a CCJ first. I remember having hassles over alleged overpayments of Tax Credits - approx £4.5k - they were very persisitent and argued I had not sent letters when I had or they had said something different on the phone. In the end I submited a SAR to them and on receipt was able to find the letters they said had never been sent but the clincher were the 2 CD's of telephone calls. In the end they agreed that not only did I not owe them anything but in actual fact had been underpaid!

Unless Good Queen Brenda ("Gawd bless 'er!") has sold the alleged debt.The DCA acting for HMRC has no powers to take you to court by themselves since they don't own the account.

Did they make any adjustments to your payments after you informed them? Do you have copies of the letters you wrote?
How I wish I had a printer but a few years back I didn't so have no copies of letters. They seem to only 'catch' up with me when I claim benefits, as if there's a 'trigger' somewhere. Should I write to them again? Should I ignore it? Don't think I can as I'm so worried but neither have I got the funds to pay it. Feel like going for lowest of low payday loan just to get rid of them, letter is written with red writing and I'm worried they arrive at door

Further to my earlier posts, I'm now getting constant phone calls from this company, (didn't reply but googled the number) late evening and 8:20am, really don't know what to do. I'm stopping everyone answering the phone in case it's them. I've suffered badly with mental health issues in the past and feel it rearing it's ugly head again

Time to be tough
Get in touch with HMRC and find out if there is a debt,as Des8 says SAR them and find out ,DLC are doing what HMRC expect them to do albeit in a way you and the rest of us don't agree with they work on a fee or percentage basis so the money is what they want. Your health problems at the moment do not matter to them besides they don't know about them.
Remember until its proven you maybe owe nothing its public money that's claimed so talk to HMRC ignore DLC if you are happy to do that DLC will pester its how they work and how they earn money.
In no way am I defending this DCA or any of them but they are there and chase people for money is what they do.

Has harassment of alleged debtors now been legalised?Remember until its proven you maybe owe nothing its public money that's claimed so talk to HMRC ignore DLC if you are happy to do that DLC will pester it's how they work and how they earn money.
Aren't their clients vicariously liable?In no way am I defending this DCA or any of them but they are there and chase people for money is what they do.
