        My boyfriend's boss has kindly offered to lend him the money to pay the fine in full. Could somebody please tell me if we went to the court and paid it direct if the distress warrant be revoked. He really doesn't want to have to give the money to the parasite from Marston's?

          Unfortunately the fees may well be payable, and will be the best way to end the issue, otherwise if the fine only is paid the bailiff will call again whether the named debtor is there or not, (if he did turn up you are entitled to call the police to remove him as the debt is not yours) unless there is a fault with the way the bailiff executed the enforcement. You should still complain to HMCS regarding the threats he made to take your goods and the stress.

            Why do so many people think they can avoid Bailiffs fees if they pay the fine in full after the Bailiff has vecome involved?

            If the Bailiff has acted within the law they have a right to be paid.After all you could argue that you paid the council car park fee after the penalty charge has been issued and hope that's the end of it.
            As much as I despise bailiffs if they are carrying out their job within the law that's it.

            Sorry to say that I think some people choose to ignore all the paperwork regarding fines and penalty charges until the Bailiff calls.

              There is nothing to prevent your boyfriend going to the court and paying the fine and lawful fees due at the court Fines Office. He will need to get a receipt from the court to show he has paid. Once what is owing on the fine plus lawful fees due to Marstons are paid, the distress warrant is discharged (cancelled).

              A copy of the receipt should then be sent to Marstons. Keep a copy handy in case the bailiff decides to be a tit and turns up on your doorstep which can be pressed into his grubby mitt just before you close the door on him.

              As regards making a complaint about the behaviour of the bailiff, you should, in the first instance, make a complaint to Marstons. However, I would put the following at the foot of the letter -

              c.c. HMCTS Correspondence, Complaints and Litigation Unit

              You should send a copy of the letter, together with a formal letter of complaint, to HMCTS at the following address -

              Correspondence, Complaints and Litigation Unit
              H.M. Courts and Tribunals Service
              102 Petty France
              London
              SW1H 9AJ

              It is likely the complaint will be dealt with by someone on the HMCTS Criminal Enforcement Team. Please be assured that complaints of misconduct towards third parties by contracted bailiffs acting on behalf of HMCTS are taken seriously by the higher levels within HMCTS.
