HMCTS Fine - Marstons Final warning - fine is paid

Hi a colleague has received a final warning through the mailbox relating to an unpaid fine issued by the HMCTS.

The amount stated is £400 the original fine has been paid, twice!! It was paid a few days after the final steps notice was issued but no receipt was ever received, it was paid online by credit card.

After the visit this morning, (no one was in just the dog) the fine was checked using the account number etc on the final steps notice, it didn't register as paid, so my colleague paid it again using the same card as the initial payment.

Can marstons still pursue him for their charges? and what action do you advise him to take tonight, they stated they would return after 1900hrs.

any advice will be appreciated.

Your colleague needs to speak to the court that imposed the fine first thing tomorrow morning and find out what has happened. Before he rings the court, he needs to check with his credit card provider how many payments to HMCTS have been debited from the card.

If the distress warrant Marstons have was issued in error, it may be a case of Marstons can go whistle for their fees. However, the court does need to explain what has happened.

After having paid the fine a few days after receving the "Further Steps Notice" your friend should have taken a note of the payment refence at the end of the transaction, then an email would have been received stating that £XXX was received against case number 8digits and a letter.

If for some reason the payment went unregistered then the Court would have issued a Distress Warrant and given the job to Marston.

Your friend should have received a letter from Marston stating that they were in possession of a Distress Warrant issued by HMCTS ANYTOWN for £XXX, and now the debt was £xxx + £85 Compliance Fee, your friend had seven days from the date on the letter to pay or to get in touch with Marston to discuss the issue. Why did he not do something then?

The Warrant was issued because (if your friend paid) of an internal mistake at HMCTS, however, do follow BlueBottle's advice, because only the Court can stop Marston in it's tracks.

Until the Warrant is placed on hold or withdrawn Marston will pursue the matter.

If your friend is forced to pay their fees, because they have seized his car for example, then if the warrant was issued in error the HMCTS will refund him.

If the fine had been paid a card statement would show the payment,dont know about paying court fines online but most online transactions produce a printable receipt
