    Hi all, I am new to this. I will try and explain in as much detail as I can.

    Yesterday (05/12/13) I had a knock on the door, however I was pre-occupied upstairs to did not have time to run to the door. I then went to my front door to find a letter had been posted to myself. I opened it and read that I owe over £600 to Marstons. I phoned the telephone number at the bottom of the letter to get in touch with the man that posted it. I asked why the debt had come from HMCTS Thames Valley when I live in Somerset. I then asked him why I owe this amount of money, he continued to ruffle through his notes and explained it was from a fine from 2009 and he did not know the sum of money owed then (I did go to court in 2010 about this fine and payed money there and then) He said the debt is for 2 debts outstanding. I explained I could not afford this kind of money just before Christmas, and he told me to beg and borrow from friends and family, and that they did not care if they had to use 6 different credit cards from 6 different people, they just wanted their money that day! He then told me if I cannot pay the full amount a no bail warrant for my arrest will be issued.
    I currently live with my partner and his mother, and the only things I own in this house are my clothes. Can they take other peoples belongings? I am also 19 weeks pregnant, and last night I had bad pains in my tummy and called 111 who gave me advice. I also did not sleep. I am completely stressed and scared to answer my front door.
    I know I should of payed the debt years ago, but I payed nearly the whole lot when I went to court which was an ordeal in itself, is there a way that the court will have a record of that payment. Or is it too long ago, and would it be worth it? I am at a complete loss at the moment.
    None of my friends/family can afford to lend me money.

    Any advice at all would be very much appreciated.

    Hi Marie and welcome to Legal Beagles.

    The first thing you need to do is contact the court that imposed the fine and ask them what is going on. As for the arrest warrant, these are for those who won't pay and actively avoid paying fines, not those who are unable to pay. In this respect, the bailiff has been disingenuous. Telling you to get into debt is unacceptable. Your pregnancy means you are in the "vulnerable" category and H.M. Courts & Tribunals Service (HMCTS) have strict rules governing the way bailiffs deal with fine debtors who are classed as vulnerable.

    The course of action you need to take, initially, is as follows -

    Stage 1

    Contact the court that imposed the fine, first thing on Monday morning, and ask to speak to the Fines Officer. If they are unhelpful, ask to speak to the Court Manager. Explain to them the situation and that you are 19 weeks pregnant. It is likely they will ask you for proof, which will be a letter from your GP or midwife confirming your pregnancy. Complain about the bailiff's behaviour.

    This is what you need to do in the short-term. You will need to send copies of the letter from your GP or midwife to the court and Marstons.

    As for taking possessions, bailiffs under contract to HMCTS can only take possessions belonging to a fine debtor and not third parties. They cannot take your clothes.

    I would, as a precaution, ring Marstons Welfare Team and explain your pregnancy and the bailiff's behaviour to them. Make it clear you will be ringing the court on Monday morning to chase the matter up and establish what is going on.

    There are three other stages, but these do not apply at this moment in time.

        Not unless they want to be attacked by Animal Rights activists. The other thing is that the mink could turn round and savage the bailiff. I'd feel pretty savage if someone turned me into a coat! :grin:

              Take copies of your Hospital notes about the pregnancy and post them (recorded delivery) to both the Court issuing the warrant and Marston.

              Call the bailiff (record the call) and tell him/her that you are pregnant, if the bailiff ignores your statement they are going to be knee deep in the hoopla, but do not be surprised if he/she will want to see the hospital notes.

              As far as an arrest warrant without bail it's up to the Court to decide this.
