Hi, I'm currently having issues with B&S, I had a council tax debt at the beginning of the year, I stupidly let the bailiff into my home and signed a walking possession order, I didn't realise that in doing so I would be charged more fee's (he didnt explain it at all) but I signed it.
I had missed a few payments as I was on benefits and couldn't keep up with them, they sent me a letter stating I had to now pay the amount in full or my goods would be removed. So I borrwed the money and paid the debt (in september). Or so I thought, I had a phone call from a B&S bailiff last week sayi g that there was an outstanding blance, I informed him that I've already paid and would be ringing the company direct. I did this and all I got told that money was still owed and that I should write a letter of complaint, which I have done.
Ive now had another vist at 7.45 this evening and a phone call saying that he would return tomorrow and remove the listed items. I dont even know what amount they are now asking for. What can I do before he returns tomorrow?
I dont want my children to witness this and as far as I was aware I paid the total due.

Hello! I can only assume that if you paid on the telephone you used a debit/credit card, then you should have a statement from the card provider with an entry for the payment to Bristows.

Did you get a receipt? If not ring them today and ask for one to be emciled to you.

Which Bailiff firm is asking you for money now? If it is Bristows call them and ask them what are they playing at, because once you paid what they were asking for, even if they made a mistake they can not come back for more.

I can get a statement. But they're saying that a bailiff was sent out on the day I made the payment so I have got charges. Its Bristow thats asking for more money.

Your problem should be a WARNING to everyone that allowing a bailiff into your home is going to add a lot of money to the debt.

I am constantly surprised as to WHY people allow bailiffs into their homes !!!
Firstly, you need to post back with details of the amount of the Liability Order and also details of any charges applied to the account when you signed the Walking Possession.

Next, what goods were levied upon?

How much did you pay and was the payment made within the time scale allowed by the bailiff when you signed the Walking Possession?

How much is the bailiff now seeking?

Can you also list the items they "seized" exactly as described on the Notice of Seizure they left you? Have you had a breakdown of the fees they are charging? Have you confirmed with the Council the amount the Liability Order was for?

Is there anyone in the household who is ill or disabled? Are you on any Benefits?

Is it possible you can provide a timeline of when this first started including dates of contact/visits by the Bailiffs, dates of any payments made & dates of any payments missed?

Did B & S or the bailiff say that they had to enter your home and gain a levy before they could set up a payment plan?

I have noticed that this is becoming an increasingly more common form of malpractice amongst certificated bailiffs and is, at best, deceitful conduct. If the bailiff or bailiff company is doing it in order to increase their fees, then the practice could be more serious that just deceitful conduct.

As for the nonsense with the fees B & S are now claiming you owe, I have to agree with Sir Vere. Once you have discharged the debt, that is it. B & S cannot come back for more. In fact, with a Liability Order, once the CT debt and lawful bailiff charges have been discharged, the LO ceases to have any effect. B & S cannot use it as leverage or a means to remove or demand more money. Putting it bluntly, they are treading on very dangerous ground, legally.
