    Hi everyone,

    Some people will know that i've been on this forum before, and have posted on another part too. Those problems from my HSBC thread have lead me back here.

    The Council have just informed me that my one months missed Council Tax Debt has been referred to Excel for recovery for the full £420. I have phoned them and reqiested them to take the debt back they refused, I have told them I suffer with depression and am taking anti-depressants, they don't care. They offered to give me Excels phone number, I didn't accept it as I'll not be talking to them. I have made a payment via their internet portal making it clear the payment is for last year. I sent them an email with the receipt number and my account number and clearly stated it is for last year. As a result of my last contact with Excel I do have the head of revenues email address. I have sent her an email explaining her oafs did not leave any paperwork, did not speak to anyone and did not gain entry. I've told her i'll send her contemporary records each time they come.

    The person on the phone told me it "was in the process" of being sent to Excel, when I told her two oafs came to my door this morning she said they couldn't have done, we went around in circles and she says it couldnt have been Excel for CT.

    Before I have to start opening the door, or not, can someone just tell me the best way to handle this. I am at day one with the Bailiffs and need to keep it as inexpensive as possible.

    Hi Rob,

    Don't forget that Excel also enforce unpaid court fines for HMCTS. As regards, CT, local authorities are required to send a reminder, followed by a second letter, then a summons and obtain a Liability Order before they can involve any goons like Excels.

    If the local authority has not followed these statutory procedures, both they and Excel are in deep, deep doo-doo.

      We're both very law abiding citizens, we have nothing from HMCTS. It's a strange coincidence that I miss one month, get a letter (i'm not aware of any other letters) that says it's been sent to Excel and then two oafs turn up, It has to be for CT. We stayed Exels arrival on this account in March when I set up a regular payment, and it has been paid regularly until I missed the payment in October. Just re-looking at it all there was no reason to have missed that payment, there was funds in my account. I need to speak to the bank.

      If i've read other posts correctly then, I can just keep paying the council online or in person and refuse all communication with Excel?

        Well, it seems this has been resolved.

        My wife was paying this years CT from her account, I was paying the arrears from my account. When the direct debit was returned from my wifes account they cancelled my payments for the arrears and sent a letter to us to threaten us with bailiffs. I had a thought that they must have requested my payments a day or two early - which meant i would have nothing in my account - but when i questioned them, they eventually told me the money had been taken from my account on time every month until the missed payment for this years CT from my wife's account. Then THEY cancelled my payments and threatened us with bailiffs.

        My DD has been set up again and she tells me bailiffs have been called off, i'll get written confirmation in a few days.

        Case Closed!

          Check to see if they have been granted a Liability Order. If they have not, both they and Excel are in the proverbial. It is illegal to pursue distress without lawful authority.
