Neither of them are showing on the register.

Bluebottle, it wasn't all from the 'other' website, alot of it was read on here and other websites too, I used that website for case law quotes mainly.

Why is it dodgy? Is all the info inaccurate?
The person who owns the "other" website is extra terrestrial and a lot of what is on there is not entirely correct.

You do need to confirm the certification of all the bailiffs Chandlers are claiming are involved in your case. If any prove to have not been certificated on relevant dates, Chandlers are going to have some explaining to do.

esbee, Bailiff Register people may have meant well inasmuch as they DO update once a week - but if the courts doing the certificating don't send the info through, that's where problems arise as you think they're not certificated, but unfortunately they often are. That's why it's so important to confirm direct with the court they claim has actually issued the certificate.

Bromley CC said we need to email them for the info, so will get that done as soon as possible.

Before we tackle any actual or suspected law-breaking by the bailiffs or Chandlers, we first need to confirm whether the bailiffs are, indeed, certificated and were certificated when the alleged levies were obtained. Therefore, a letter to Chandlers, along the following lines, is needed, in the first instance -

            Dear Sirs,

            Referencexxxxxxxxxxxxxxxxxxxxxx

I refer to your email/letter dated [date] in which you list the names of bailiffs you claim attended my property.

On checking with the Certificated Bailiff Register, held by the Ministry of Justice, I find that the following bailiffs in Chandlers' employment are not registered -

            [List of Bailiffs' Names]

In order to ensure the bailiffs were, indeed, registered on the dates of their alleged visits, I require that Chandlers provide me with the name(s) of the court(s) that issued their respective bailiff certificates under the Distress for Rent Rules 1988. I would remind you that it is a legal requirement that both Chandlers and the bailiffs concerned provide me with this information and that failure or refusal on the part of Chandlers and/or the bailiffs concerned to provide this information would bring into question not only the veracity of any statements made by Chandlers and the bailiffs concerned, but the lawfulness of any action by the bailiffs named and fees relating to any alleged visits made by them to my property.

Would you, therefore, please ensure that the information requested is provided to me within seven calendar days of your receipt of this email/letter.

The co-operation of Chandlers and that of the bailiffs named above in this matter would be appreciated.

            Yours faithfully,

            .......................

The first priority is to establish whether the bailiffs named by Chandlers were certificated on the dates they allegedly visited your friend's home. In order to do that, the names of the courts that issued their certificates is required. An enquiry with the courts involved will confirm, either way, whether the bailiffs were certificated on the relevant dates. If it transpires that some or none of the bailiffs were certificated on the relevant dates, this will bring into question the lawfulness of any levies and fees and Chandlers' actions.

Once this has been done and your friend has checked out the bailiffs certification, come back onto this thread for Round 2.

            Hi All,

Please see the below response from the Bailiff Register, we are still awaiting a reply from Bromley CC, but we are eager to get the letter sent off before it's too late.

            Good afternoon

Thank you for your e mail, the contents of which we note. We suggest you contact Bromley County Court to request they check their register of bailiffs as the Certificated Bailiff Register is not showing all the names you requested.

Mr Brocklehurst's certificate has expired on the register but you need to contact Bromley court to check whether they have renewed it without informing us.

We require the full name of Mr S James as there is no bailiff registered with Bromley with that name.

We are unable to trace a Mr Smith as we require a full name.

We are unable to trace a Mr Z O'Sullivan.

Mr M Simou's certificate has expired on the register but you need to contact Bromley court to check whether they have renewed it without informing us.

Please contact us if you require any further information.

            What do you guys think?

email bailiff office again stating that you require full names as above, plus check with the court to see if the other certs have been reissued. If you can get to the court while they are open, they must (as in legally required) have a list of currently cert'd bailiffs on display somewhere - can you/someone get down there and have a look?

                Hi Demented,

I can't get full names from them as they are the ones that want them from us, and we don't have them.
We are still awaiting a reply from Bromley, my friend is going to call them now to ask them to hurry up and respond.
Bromley is too far to go to from West London so that isn't an option.

Have I misunderstood something? EDIT - YES I HAVE - I said bailiff office, meaning Chandlers, and you thought I meant bailiff register - sorry, should have been clearer

                  - Chandlers office need to supply you with the full names of their bailiffs. Email them and say you require their full names in order to be able to check their certification as the Bailiff Register/local court are asking for full names.

                    Ah ok sorry,

I actually did that twice and they still only sent first initial or surname only tut!

                    I will do it again.

I believe they should have some explaining to do even if all their trolls had a valid certificate at the time of their alleged visit, as the purported levy was clearly invalid - exempt goods were listed and the remaining goods that could be seized would not realise enough at auction even to cover the bailiffs' fees.

Need I point out that, two years ago, Hounslow Council employed Rottendales and, through them, the appalling John Boast.

It seems that, whilst the company may have changed, the antics of their bailiffs remain much the same.

Chandler's need to stop playing silly buggers and provide full details for the bailiffs involved. Otherwise, their intransigence could mean they can go swivel for any fees to which they may be lawfully due until they do.

What made me want to find out where he lived and go round and drop the b:censored:d was when he tried to excuse his indefensible behaviour.
