Basically we have let my partner's Dad use our address, because he doesn't have a fixed address, to try and get himself on benifits. He basically floats from one friend's house to another and stays at ours when he has no where else to go. Recently we received a hand delivered letter for him, already knowing he owes DWP and a court fine this sent up a red flag and I googled the PO Box number and found out that it was from Collectica formally Phillips.Now I can't talk to him about this as he isn't around at the moment but I suspect that it has gotten quiet far as they are now hand delivering stuff to ensure he cannot say letters were lost in the post and I know he has no money because as soon as we helped him get back onto benifits he got himself kicked off again.Now what I am worried about is because he has used our address as a delivery address, if bailiffs try to take goods will they try to gain entery into our property and take our stuff because he uses our address? Should I call them to explain it isn't his property it is his sons and his son's partners?

to LegalBeagles....I'm pretty sure there's a simple procedure for declaring he doesn't live there but someone more au fait with the law will be able to clarify this for you.
It's never wise to let anyone 'use' your address unless they actually do reside there,,it can cause no end of problems and regarding benefits ,it could possibly be illegal. -

We were trying to help him get onto benifits so he could get a place of his own, it didn't work though. I don't know how else someone without their own address is supposed to claim as there would be no address to send correspondence to.
He does also stay with us from time to time as I said he stays when no one else will have him. He is a sofa surfer, some times he'll be gone for months with no word then we get a message that he is stuck somewhere with no money and can we help him get back to ours then he'll stay for day to a month then dissapear again.
As it is my partners dad I kind of feel obliged to help him even though most to the time he takes the mick. Personally I am not happy with him using our house like a hotel.Comment

Families eh?
They've obviously traced him to your address because of the benefit stuff. It needs sorting though cos Bailiffs are brutal,if they think you aren't up to speed on their tactics they would tell you the most amazing lies to convince and scare you into paying.
Your partner doesn't have the same first name and surname as his Dad does he??

Assuming that there is no financial connection, No. However, as Inca points out, bailiffs routinely break the law, so it would be wise to sort this out immediately.
Complete a Statutory Declaration to the effect that there is no connection, that none of the property in the house is his, and that the address is simply used by him as a mail drop. Send copies to the bailiffs and to everyone that he owes money to. Use Recorded Delivery.
When you've done that, kick him out for good, because this is just a foretaste of what is to come.Comment

you have had good advice so far, just make sure that the Stat Dec is done ASAP, and keep one copy at home to shove into the bailiffs grasping paw when he looks like he wants to clamp your motor, or tries to get a foot in the door. In fact film the muppet even with a mobile phone as you give him the Stat Dec, to record the threats and expletives he will probably bawl at you, so you can complain to the court if they persist.Comment

There is no reason why a homeless person should not stay with you occasionally. Kicking a family member out permanantly could cause a lot of unnecessary ill feeling, unless you feel you must. See this link:

He should declare himself as homeless to the DWP however, rather than suggest he is living with you, as may be the case at present - I understand you're trying to help, we've done the same with my stepson and it went pear shaped. It's easier in many respects if he can use another firend as a temporary address, as family links can create problems either legally, or just within the family, neither of which are pleasant or desirable.Comment

Sorry Labman but I totally disagree with the 'ok to use address' scenario.
If a person doesn't live at the address then to state he does is a lie...and to sign a legal document (benefit claim) stating that lie is surely illegal??
The man in question is not living with OP,,she doesn't know where he is but because he's falsely claimed to be living at her address Bailiffs are sniffing around,,and we all know bailiffs don't give a monkeys whose lives they disrupt to try and get their chubby trotters on cash.
I'm all for the 'drinking from the cup of human kindness' and helping people but times have changed and so has the debt collection industry/benefit system.
It's a sad day when we have to admit we can't help family/friends but we have to protect ourselves and our own lives,,he doesn't live there...never has lived there so therefore should NOT be using her address.

@ Inca and Labman, I can see the reasoning behind both arguments, but long term, Inca is correct in so far as council and DWP will not take the homelessness as being substantive and real, and assist in finding suitable accommodation whilst nominally resident with a child and their family.Comment

I'm old enough to remember the days when one could up sticks and go and stay with Uncle John over in Ireland for the 6 week holiday and noone gave a monkeys,,the 'dole' wasn't bothered,the 'sick note' office neither knew nor cared and 'rent cheques' came on a Saturday morning and could be cashed (along with dole giro) at the Post Office and no ID was needed.
Those days are long gone.....and taken a lot of 'family sticking together' with them.:tinysmile_cry_t:Comment
