Hi,

Im in need of some help please. I received a letter yesterday from Marston's stating that i owed them £110 for a penalty notice. I had no clue at all what the penalty notice was for as ive not heard anything about it (I moved house a year and a half ago, i completely forgot to change the address my car was registered at until April this year - stupid i know) Anyway i called Martson's and was able to find out what the fine was for, the woman on the phone was extremely unhelpful and told me that i had to either pay the full amount within 7 days or if i paid £50 they "might" be able to work out a plan. I told her that i dont have the money as i dont get paid until the 15th of the month, she wasnt interested and just kept repeating the same thing and refused to let me speak to anyone else. My question is are they allowed to demand a payment within the next 7 days when i quite clearly dont have a clue about any of this? The woman from Marston's even said that they had traced me to my new address so its ovbvious i dont know about it, also the letter was only date 01.11.13 and i called them on 04.11.13 as soon as i received the letter as i want the matter sorting.

Any help would be grately appreciated.

This does not even begin to make sense.

The demand for £110 presumably includes the standard "compliance fee" charged by Marstons, which is £85. This means the penalty notice was only £25, which does seem rather low.

It may have been partially paid by the person liable to pay, leaving £25 in arrears and Marstons, in "tracing" the debtor, have concluded it was the OP.

When was the penalty notice incurred and when did the OP purchase their motor-car?

Having read through this again, it is obvious the "woman at Marstons" has crossed the line. They must give you details as to who the creditor is and under what lawful authority they are acting. In the absence of such information, Marstons are on a sticky wicket, in the legal sense.

I'd be interested in your response to CC's thread. That aside, if you believe the fine amount to be correct, you might be worth trying the Statutory Declaration Out of Time on the basis that you received no paperwork. It would not be wise to mention forgetting to switch over your car address.

It sounds to me it's a Traffic management Act issue. The letter from Marston should (it is a legal requirement) tell you who issued the Penalty Notice and their reference number, also, but not necessaraly, it should tell you when the Notice was issued, the location and what for, i.e. parkingin a loadingbay or in a resident's only space.

My suggestion is that you beg, borrow or steal to pay in time, otherwise you can find yourself with a bill short of £500 if you don't.

Then if the penalty notice was issued in error you can claim your money back, it is not unknown for parking fines to be sent to the wrong person, all you need is for the "custard tart" to have written down the wrong digits, i. e. AB 12 DCE rather than AB 12 CDE.

I got away with a parking ticket in Nottingham because on the ticket the dork wrote an N rather than an M, I only feel sorry for the recepient of the fine if such number plate existed.

It comes from the days when Traffic Wardens had a yellow band around the hat and most were women.
