    Hello everyone. Thought it would be easier if i posted my witness statement on here, if anyone can give me some advice it would be greatly appreciated.

    I was at home with my 4 month old son when someone knocked on the door. When I answered it was A SEEAR from Marstons Bailiffs. He asked for Mr ****, who was at work. I told him this. He then said that as a child was present he had to turn off his recording device.
    As I was holding my son, I turned around to put him in his swing, turned back and A SEEAR was standing in my front room. I HADN’T given him permission to enter my property. I told him I wasn’t happy having him in my house, especially with my son present, who was now crying. A SEEAR went outside the property after me asking him several times, but kept his foot in the door, continually pushing the door open so I had to hold it shut.
    I felt so threatened that I said I was going to call the police, at which point A SEEAR said “You can call them they won’t do anything”.
    I tried calling Mr ****, but as he was at work he couldn’t answer straight away. At this point A SEEAR said “I’ve tried 3 times now Laura so I’m coming in to take your goods.” I explained that the house is not Mr ****s, and that all belongings in the property belong to me.
    I finally got Mr **** on the phone, and A SEEAR was speaking to him and refusing to leave me alone unless he got full payment of £830.00.
    The intimidation and stress this was causing me was too much and I ended up having a panic attack. I was physically threatened by A SEEAR which was obviously causing me distress.
    It was only when I advised A SEEAR that my father was on his way that he walked off, and took full payment from Mr ****.
    A receipt was put through the door, along with the wrong address noted on the front.
    I have sought legal advice regarding this incident and am aware that A SEEAR broke several laws today. Not only has he left both me and my son in distress, he has physically and verbally threatened me.
    Further to my panic attack I have now seen my doctor who has advised that I need to take some medication to help me with the anxiety A SEEAR has caused me.
    I have also put a complaint in with Bedfordshire Police regarding the conduct of A SEEAR today.
    Having to pay out £830.00 today has now meant that we are unable to purchase food and essentials for our newborn baby.

    What was the debt for? I feel that he has breached the National Standards by following you in, as with a newborn I would consider you vulnerable under the standards. Hopefully Bluebottle will be along soon with Labman, but I feel a complaint to the court manager, with an escalation to area, along with copies to MP.

      It was for a TV licensing fine, even though we had a license and sent it to the court, we were in correspondence with them to get the fine revoked so the guy knocking at the door was the first we knew about it not happening. We didn't get any prior notice of them coming either.

        You need to contact the court that Crapita AKA TVL have prosecuted you and gained a wrongful conviction, you have sent evidence you were licensed, and still they send a bailiff please tell me you sent them a COPY, and not the original licence...marstons will enforce with maximum prejudice until the court call them off

          Yes we sent a copy. Have sent the court a complaint form and also sent it to my MP.

                Complaint to the court manager where the warrant was issued mentioning you are appealing the conviction on the grounds you have a license for the pariod that Crapita TVL alleged you were unlicensed for, and have provided a copy to the court, mentioning how the bailiff behaved with you and a newborn.

                  Can you expand on this a bit please? I'm trying to understand how you were prosecuted for not having a valid licence when you say you did have one. Can you explain for me please?

                  Also in your first post you state it is a witness statement. I assume you don't mean a witness statement for a court, but your account of the distressing event that happened to you? You've also missed out at what point you phoned your father about the bailiff from it.

                  Do the bailiff show any identification? Did you attend court?

                  Have a read of the link below and see how it fits with your own experience. The process for a Magistrates' Court fine is pretty straightforward, so you should be able to identify easily anything which has not been followed:

                    The bailiff was far too heavy handed, but unless you can prove that he treatened you the way you say there is not a lot yoou can do except write to Court issuing the warrant and Marstons (recorded delivery is a must).

                    If you can prove that a TV licence was in place at the time of Capita's visit then the Court will refund the £830

                      Exactly so Sir Vere, but the conviction must also be quoshed, and the Capita goon who initiated the wrongful prosecution be gelded if male, and put in the Scolds Bridle if female.

                          You were convicted? What exactly was the sequence of events?
                          The TVL man came round on his rounds to advise us that the TVL DD had been cancelled (even though we were up to date with payments), We re-set up the DD on the spot with him and he updated his records.
                          We then recieved a court summons for non payment so provided them with a not guilty plea and provided them with the licence. We thought that was the last of it (This was back in August) until this thug turned up on our doorstep! We hasn't had any correspondence from the court or Marstons.

                              Can you prove this? Have you made enquiries to confirm that the DD was indeed stopped, and if so how?

                              We re-set up the DD on the spot with him and he updated his records.

                              This sort of behaviour is normal for TVL. Did you attend court and defend yourself?
