    Hi all.
    I hope someone can give me some advice. Today i had a letter posted through my letter box, from a balliff working for Bristow and Sutor. It was addressed to my son who has not been living at our address for about seven weeks. It is in respect of a parking ticket he encurred while visiting his pregnant partner in hospital. All the parking spaces were full and, so he parked on a residents permit holders only road.
    The letter says he owes £168.64 this includes £43.20 for the visit to post the letter.
    I beleive he entered into a payment agreement , but it must have been broken because he is seriously ill in hospital.
    Must i give them his new address/can they enter our premises/any help would be appreciated before I try to contact the balliff.
    Icannot talk to my son about it as he is too ill.

    Hi and welcome to Legal Beagles. No they cannot enter your premises if he is no longer resident, and you should inform them that he is in hospital and seriously ill, also inform the council parking department, or whoever controls this resident parking. Mind you Bristow & Sutor, aka Busted & stupid would be daft or greedy enough to try to levy items belonging to the hospital he is unfortunately a patient at.

      Indeed, as BB says above, you need to contact B&S AND the council over this. Write to the council with a copy to B&S asking for all enforcement action to be suspended while your son is in hospital, and for a period afterwards while he recovers sufficiently to deal with this.

        Hi I am not sure if I managed to post my last entry,( I am not up to speed with computers yet). Thank you all for your help. When I woke up this morning at seven, there was another letter from them. Delivered by the same Balliff. The fees are now£226.24, Including £55.60 for this visit. He wants to levy distress so that a payment schedule can be put in place.

          Phone them up and tell them that your son does not live there any more. They won't believe you but they now know so you can get back at them if they continue. Follow it up with a letter and get proof of postage.

          You do not have to tell them your son's new address.

          I'm sure someone else will say if the fees are valid or not.

            A bailiff does not have to levy distress in order to set up a payment plan. So what you were told in this respect is untrue. The bailiff is skating on thin ice, in the legal sense, if he thinks he can get away with that one.

            Also, as your son is now seriously-ill in hospital, I doubt very much whether B & S could approach him, at present, as he would probably fall within the vulnerable category under National Guidelines. As advised by Ostell, you do not have to provide B & S with your son's current address.

              Thankyou for the advice.
              Could you also tell me, as I am rather confused. Does this mean this matter has been to court, because there is no court reference.

                If it is local authority parking ticket (PCN), a charge certificate will have been issued by the Traffic Enforcement Centre (TEC) at Northampton County Court Bulk Centre (aka Northampton CCBC) enabling the local authority to issue a distress warrant to collect the penaltyy and any court costs they have incurred. If there is no court reference, I would treat any verbal or written statements by Brainless and Stupid with a healthy degree of suspicion.

                  With TMA warrants, when a change of address is made, it reverts to original PCN plus the letter fee, and if paid within 7 days there must not be any more fees added.

                      £11.20 plus VAT....what some companies do will soon require the servises of a sexton

                        Thanks all who replied, I have sent a letter to Bristows. I went to Lincoln County Council to deliver a letter to the parking section, I could not even get past the receptionist, she would not accept the letter. so I e mailed the chief executive, I live in hope to get a reply. I tried phoning the ballif in question, left a message , no reply. I texted him, no reply.

                          Emailing the CEO was a good idea, but you also ought to make a complaint about the receptionist and her evident "attitude problem" - she seems to have the attitude that the public exist solely to provide entertainment and amusement.
                          She needs a good slapping.

                              Do you know if LCC has outsourced its administration to a private sector company at all? Two companies that are active in this field are Capita and Liberata, who seem to be under the delusion that they run the council, not the councillors. If LCC has an infestation of any private sector outsourcing company, this might explain the receptionist's attitude problem. Emailing the CEO of LCC was a wise move.
