Collectica Notice of intent to "enter, search & removal"

I have today 31/10 received a hand delivered ( OPEN envelope dated, time indicated & marked Very Urgent ) from Collectica, for my estranged husband.

There is NO indication of WHEN they intend to call back ( if indeed they are even allowed to ? )

My estranged husband no longer lives here & works away ( I am here only while the property financial obligations are sorted )

Everything now left in the home, is Mine..... ( & has been since prior to marriage )

What can Collectica do?
What Can I do to prevent any action by them?
I Do NOT want to be stressed that they might enter in my absence & remove my belongings.

Any constructive advise would be greatly appreciated.

Hi susziq, if the debt is your ex's, is a magistrates debt and he is not resident, and it is not a debt like council tax that can be considered joint, and all the property is yours, then Collectica can go swivel, you need to swear a Statutory Declaration as to the fact he is gone, and further that the goods in the property have NEVER belonged to him, and that there is nothing there that can "LAWFULLY" be seized by Collectica for the debt of your ex, a notarised copy for the court, one to proffer to the bailiff when he comes back (film his visit even with a phone as evidence if he still tries it on)and one to send to Collectica.

Hi, I'm sorry to hear of the experience you've had.

Could you elaborate a bit on why the bailiffs appeared in the first place please? The more detail you can provide, along with any relevant background, the better we can help.

If you could also post up redacted copies of any paperwork left, that would be good.

The bailiff who left the letter (should have been sealed by the way, this is a must as the information in the letter is covered by the Data Protection Act, which means your ex-husband can sue them) should have left a name and tel number to call him/her. Do so and be prepared to show the latest Council Tax bill in which your husband name should not be on, the latest utility bills all just in your name, and going for a statutory declaration with a local solicitor saying that he has not resided since such DD/MM/YYYY, his possible new address and that all contents are yours should bring the matter to an end.

If they carry on, you could sue them for harassment

I hate to be naive, but how/where do I get a Statutory Declaration done. How much should it cost ? Notarised copy ?
Should I phone the Bailiff concerned to advise of this action? I am concerned that She might come back in my absence & go ahead with the locksmith & removal...

If it is known which court issued the distress warrant, they need to be advised that your former spouse no longer resides with you and so does Collectica. This needs to be done as soon as possible. Follow the advice given by other posters in this respect. Obtaining a Statutory Declaration can be done at most High Street solicitors for around £5-£10. A bailiff acting for HMCTS cannot force entry with a locksmith without first seeking authority from a nominated officer at the court that issued the distress warrant and must satisfy the nominated officer that there is justification for forcing entry.
