SAR Subject Access Request

Hi all,

can anyone tell me what an SAR will disclose to me if I send one to the bailiff company I'm battling with? Having telephoned Phoenix Commercial Collections and been told they can 'lawfully seize' the car without even clamping it and that they 'left appropriate paperwork at your property', I am curious as to what they issued. I was at home all day,they didnt knock on the door,they just posted a bad photo-copy of a 'Removal Notice Regarding Council Tax.....', nobody signed anything or received anything remotely similar to any official-looking document or form.
Will an SAR show up their fraudulent behaviour and poor performance? Have written to to 'Head of Finance',Bromley with template letter,awaiting reply!!

It's impossible to say unfortunately. It will reveal, in theory, any details they have about you. What they should have and what they do have may be two different things. I discovered this a couple of years ago when I sent one to a bailiff company who had made my life more than a little uncomfortable for quite a while. They and the council settled out of court with me, partly as a result of this.

SARs can have a surprisingly desirable effect, as Labman's experience shows. In a case I helped someone with, they sent a SAR to a bailiff company that was attempting to make them pay more than they could realistically afford. The SAR showed, clearly, that the bailiff company had lied to the creditor, who happened to be a government department. Not surprisingly, all bailiff involvement in that case was stopped, as a result, and the bailiff company did not get their fees.

What they should have and what they do have,& what they're prepared to admit that they have, may be two different things. Re the red - have you ever sent a SAR twice to the same company and see how different the result can be? Obviously you can't say, "You lying gits, I know you've got a piece of paper that says such and such!" However, you need to ensure the data is likely to have changed from one request to the next, or ICO guidance states the data controller does not have to comply the second time.

The one time I've discovered a significant difference was where the data held by two different organisations should have been broadly similar, and there were definite areas of overlap (imagine the Venn diagram - big central overlap due to letters between the two organisations relating to me where both organisations should have sent identical copies) - oh no, totally different results.

This confirmed to me one organisation was being selective beyond what is permitted.

The Civil Procedures Rules 1998 can be useful in forcing data controllers to disclose documents as CPRs supersede the Data Protection Act.
