    I was declared bankrupt in January 2013 and put what debts I had into this to clear them. I thought long and hard on doing this.
    Now what I need to know is that one of the creditors (debt company) who was included in the bankruptcy has sold this debt (this month October) onto another debt company.

    I did not think that they were legally allowed to do this.

    So a debt that I thought was finished with has now come alive again.

    By the way I was discharged early in September as I had no assets and was not working or claiming any benefits as my husbands supports me.

    Debts can be sold, I've even heard of a well known case where the account was ruled unenforceable in court after the judge filed in favour of the defendant, being sold. In the case of BR, your debts are 'transferred to' and managed by the OR, regardless of who actually owns them. That doesn't mean the debt has 'come alive' again. Out of interest, WHO is the new owner?

    I note you've posted under bailiff issues, have they threatened you with bailiffs?

      hi well it seems that it's been sold to Marlin Europe VI Ltd, which I thought was a bailiff company but it seems after doing some research that it's part of NRAM (Northern Rock) even though they say they've sold it on. I did not think that a debt that was in a bankruptcy could be sold on.

        Ah, Marlin, they are well known (and much "loved" ) debt purchasers. They are not part of NRAM, what they've done is purchase a whole portfolio of defaulted NRMA loans, hence the relationship: http://www.credittoday.co.uk/article...-up-nram-loans

        Debts are bought in bulk with little or no details about them. Debt purchasers pay pennies in the pound for them and the debts purchased often include some that are statute barred, unenforceable, etc., a nice little assortment of lemons amongst the recoverable ones.

            In order to avoid hassle, it may be worth sending them evidence of your BK so they leave you alone.

              They already have it. They were informed by the insolvency in Feb and also in August when they had 4 weeks to say they did not want my BR to be discharged early. I spoke to Northern Rock myself in April and they informed me that they did have notice from insolvency. They also admitted today they knew about the BR it was on their system. So not sure why they sell this debt on.

                I meant tell Marlin it was subject to a BK order and no longer exists. They should stop pestering you then.
