      The court can suspend all enforcement action whilst something like a health issue that brings the defendant within the vulnerable is dealt with. Collectica very foolishly continued with enforcement action after being told enforcement action had been suspended by an HMCTS Area Enforcement Team earlier this year. Sooner or later, I can see Collectica losing their contract or not having it renewed. Their parent company - SERCO - isn't exactly in the MoJ's good books at the moment, are they?

      It appears that HMCTS takes a serious view of contracted bailiff companies continuing with enforcement action after HMCTS has told them to cease.

        Totally agree, but until the Court "Managers" take on board the fact that some Civil Enforcement Agencies are prepared to break the rules and actively tell their boots on the ground to ignore the guidelines, nothing will happen, and forums like this will live on for many years to come.

          Problem is many court managers think that the bailiff can do no wrong. Some of the cxurrent crop of bailiffs would tow a car or seize goods of relatives even if the debtor had died, on the day of the funeral. just as bad a council parking goon clamping the hearse outside the church.

          The Enforcement Industry is out of control.

            What you say is very true, Sir Vere. However, my experience of the HMCTS Area Enforcement Teams, especially Service Delivery Managers and Senior Enforcement Managers, is that they are very helpful and will nip any rule-breaking by AEAs in the bud before it gets out of hand. An HMCTS Area Enforcement Team killed an AEAs pig earlier this year when the AEA blatantly lied to the debtor and HMCTS and hung themselves in a SAR the debtor requested from the AEA.

            The private sector should never have been permitted to become involved in the enforcement of court fines. Experience has shown that whenever and wherever the private sector has become involved in the provision of public services, fraud and corruption has arisen. I discovered this when I was a CID officer. Ultimately, it is the politicians who allowed the private sector in and must carry the can for what is happening.

              However, as the Serious Farce Office is involved, criminal charges seem unlikely regardless of how many "discrepancies" are revealed.

What beggars belief is that Chris Grayling said, publicly, that both SERCO and G4S could tender for further MoJ contracts, despite knowing that they were both under investigation for defrauding the public purse. The man is either seriously deluded or has no moral compass whatsoever.

                  This situation is abhorrent and obnoxious, Grayling is a first class onanist and five finger pianist, along with the rest of the Toffs and opposing pinkos. Serco G4S and Crapita should be removed from any government contracts at all levels, they are unethical, greedy corrupt, and need to be investigated and transgressions prosecuted to the full extent of the law.
