    Hi all, what can i do if the bailiff wont accept a copy of a signed agreement with my daughter to sell the car to her last year, and a signed document from the solicitor as advised above, they say they wont accept these as they dont believe me and are still going to take the car, what can we do please, i have until wednesday to get this sorted.......

      Unfortunately, the bailiff is not in a position to refuse to accept notarised documents. They know that it is not only a civil tort to take and sell goods belonging to a third party, it is also a criminal offence. I would get your solicitor to warn B & S and SGC that any attempt to remove the car will result in legal action being taken against them both. The last time a bailiff company did something like this, the third-party owner of a vehicle had it returned within 24 hours of a solicitor's letter being received by the local authority involved who were less than pleased with the bailiff company involved as it cost the local authority a lot of money in legal costs, compensation, damages and other expenses.

        As bluebottle has already indicated B & S really does mean Bonkers and Stupid, as to wilfully ignore a Statutory Declaration effectively opens the trapdoor from under their feet. They would be most unwise to take the car.

          Absolutely, BB. Even a person of limited intellectual ability would know just how unwise it was to ignore a Statutory Declaration. And it doesn't stop there. Not only would B & S get it in the neck, along with the creditor, but so would any tow truck operator who was involved in the unlawful/illegal removal of a vehicle a bailiff had no right in law to remove. They would be liable to be pursued along with the creditor and bailiff. I know of nothing that would provide them with any protection from civil litigation or criminal prosecution.

            If Bonkers & Snatchit do fetch up with a tow truck, OP should call the police to report ongoing theft motor vehicle, and show the copper the Stat Dec which the bailiff and the minions are ignoring. If the copper supports the bailiff, after that it will look very bad for them imho.

              Just want to thankyou all for the comments and advice, the council have also been given copies of the signed agreements with our daughter and the solicitor, i also included a long letter of formal complaint about the bailiff and his lack of correct procedure, no showing of ID no legal docs to prove council gave them permission to collect on debt, i requested as per government guidelines for council and bailiff they can recall the debt....bet they wont though, so what happens if they turn up at the door? I guess i just call the Police then.......great, that will create a stir in our small close....thats all i need!!! People out watching and listening to our business.....

              But thankyou guys for all the tips and advice......oh B&S also seng me a form asking for national insurance numbers and both our work details.......it was sent back empty explaining i saw NO laws tosay we need to supply this...i work for the NHS, so no way do i want them turning up at my surgery making a scene!

                If they did they would be very silly indeed as a call to police to remove them would be a valid option, they are not entitled to fetch up at your workplace and start demanding anything, they risk arrest if they do that.

                  But what if the copper didn't back the bailiff and made a decision to seize the tow truck, BB. Now that would be a turn up for the books. However, I suspect the copper would have a Breach of the Peace on their hands as the tow truck driver attempted to wrap a tyre lever around the bailiff's head or tied him to the spectacle lift on the back of the tow truck and drove off down the road with the bailiff screaming for mercy and the copper sprinting after them.

                    Hahaha....nowv that certainly is a sight I would really love to see?..........and would be well deserved on the bailiff for sure, they really are the most horrid people.....well our one is.......
