hi i need advice bailiffs turned up my house 2 days ago for my son sed he owes 757.00 for rail ticket fine in 2008 its been to court the bailiffs sed but my son does not no any think about this and it was at my old address can any one advise me please we havehad no letters whats so ever

He must know he was caught travelling without a valid ticket or how would the rail company have got his name and address?
As for the bailiff threatening to take your stuff the cant its not your debt its possible his and he is liable.Get himto find out about the fine the court ETC.

Right. You need the following information -
1. Date of Alleged Offence;
2. Venue of Alleged Offence;
3. Date of Court Hearing;
4. Address to which summons was sent;
5. Whether defendant was present in court;
6. Address to which Further Steps Notice was sent;
5. Evidence of any photo/video the train company took of the offender at the time.
Contact the court that imposed the fine for the above. If a foul-up has taken place or the real offender has used your son's name without your son's knowledge, it may be necessary for your son to attend the court and swear a Statutory Declaration to set aside the conviction.Life is a journey on which we all travel, sometimes together, but never alone.

i said to the bailiff about camaras at the station to prove it wasn't my son he said they wont have it now to long ago and then to me carnt your son borrow the money the thing is my son only gets his mail here now and they want to take stuff from my house

You need to find out which court issued the Distress Warrant and find out what has happened, or, rather, your son needs to find out what has happened. As for the bailiff, speak to the company involved. If they refuse to engage or listen, then escalate the matter to the HMCTS Senior Enforcement Manager for the area in which the court that imposed the fine is located.
As such, the bailiff can only seize goods belonging to the debtor, not third parties.
Get the ball rolling asap and don't let the bailiff intimidate you.

It's a common thing for someone to give a false name and address for a train or bus ticket,. first the third party knows is when the bailiff calls. If it is a genuine case of ID fraud the Stat Dec to the court that issued the fine is imperative without it, it cannot be quoshed, or the case reopened to be dismissed. The bailiff will be anxious for you to pay for the fine as he doesn't care who pays. If you or your son did pay, the bailiff, at this stage even if it was quoshed later, you would likely have to sue marstons to get your money back.
