    Good evening,

    I came home from work today to discover that my car was not where I had parked it on Sunday. After some searching online I called the TRACE helpline who were unable to tell me whereabouts my car was and so suggested I call the police. On calling the police I was told that my car had been towed by Newlyn bailiff on 7th October (Monday) and was given a mobile number to call. On calling the number I was told I'd be called back in 10 mins as the guy didn't have my information on him and so at this stage I had no idea why my car had been towed as I did not receive a seizure notice.

    Over an hour later I still hadn't been called back (he forgot) so I called the bailiff number again and was told it related to a PCN and that the total cost was £1,079.44 and is going up by £40 a day. I don't know what the PCN contravention was - other than paying the sum above(which I haven't got) is there anything I can do to stop my car being sold.

    All advice will be gratefully received....

          Without seeing the details
          of the contravention I can't be 100% but am pretty certain I don't have any outstanding PCNs

              In that case ask to see the Warrant as it should list the Council involved, date & offence.

                I have the PCN number so know which council it's from. What can I do to stop my car been sold?

                  If you have never received any previous paperwork then first thing in the morning get on to the Traffic Enforcement Centre at Northampton and explain you have received a Bailiff for a ticket you know nothing about and wish to file an Out of Time. They should be able to email you the forms, & if you return them before 4pm they should notify the Council to halt all action pending an investigation.

                  Incidentally when was the last time you moved?

                        It is very difficult to adequately advice on what you need to do unless you are able to provide more that a one line response to queries.

                        If you had not received a Notice to Owner/parking ticket on your car then there is a simple procedure which is called an Out of Time witness statement. This form is sent by email to the Traffic Enforcement Centre and all enforcement will then be on hold by about midday tomorrow. No further bailiffs fee (including storage fees) can be charged and neither can the car be sold.

                        Firstly, you need to contact the local authority to ascertain when the PCN had been issued and what address etc.

                        I am shocked at the fees as they cannot possibly be correct. Which local authority does this relate to?

                          What plate is your car? I have heard of this happening where an innocent motorist's number plate has been cloned. You certainly need to ask for details of where the alleged contravention took place. If you have proof you were not in the place the local authority concerned alleges your vehicle was, both they and Newlyns are going to be in a bit of a pickle.

                              Apologies for the short responses, they're not deliberate its more a fact that I actually don't know the details of the PCN until I call the council in a short while. I've had a look through my letters and have drawn a blank so I'm obviously concerned about the amount of money I'm been asked to pay an what will happen to my car should I not be able to get the money together.
