    Not good for me! I work from home and am bloody terrified they will come and try strongarm tactics. I've been reading so much about them! If they do, and it's unlikely, do I just shout at them to go away as they have no jurisdiction in Scotland? Will they accept that?

      I don't think it has yet registered either with Marstons or the Court in Manchester that they have no jurisdiction. By continuing this facde they are leaving themselves wide open to a claim of harrasment. As for whether they will actually travel all that way - lets just say it won't happen. Send an email to gareth.hughes@marstongroup.co.uk - he is their CEO appraising him of your current situation, hopefully he may take some notice and act accordingly - make sure you ask for a read receipt. you could also point him to this thread.

        Thanks for the advice. I think I'd rather lie low than contacting them at the moment. Once we have the affidavit sent to the court I will feel a bit easier. The thing that is so galling about this whole farce is that they have given no proof or evidence to back up their claim that husband rode the Manchester bus without a ticket. He has a very common name, which for some reason they have decided belongs to him - 400 miles away from where it happened. It's all just their word against him and they won't give any information at all as to why they have decided a man who lives in a remote part of Scotland with a very common name is obviously the guy who defaulted on paying for his ticket in a city where there are probably hundreds of men with the same name!

          That's because it is a lot easier to find someone who matches the part rather than look for the actual offender. I would have assumed that public transport in Manchester is more than likely fitted with CCTV so they probably even have a picture of sorts. Have you spoken with the Enforcemnet Office that covers Manchester?

            No. The offence happened in 2003! They first got in touch round about 2008 and then it all went quiet as they accepted that it was unlikely to be him. Now in 2013 it has cropped up again because someone noticed the old file had not been closed. I don't know if the Enforcement Office would still have bus cctv images from 2003.

              If Marstons were stupid enough to come to your house, you could rightfully call the local police, as Marstons have no authority under Scottish law, the local plod would not be happy about a Sassenach bailiff chucking their weight about ultra vires in their manor. The bailiff may well enjoy a holday in Barlinnie Jail for demanding money with menaces.

                I will do that. I will call the local police station and say that I am a frightened wee woman, home alone, and some big thugs are trying to break into my house!

                  Update. My husband went into the sheriff court and swore on oath before the JP that he is not the person and has never been to Manchester. The court has sent it to the Manchester court. We've kept a copy and so far we've heard nothing. Husband is going to ring them to make sure they received it, and also ask them to confirm in writing that the case is now closed.
