    Hi,

    I hope I can get some advice.
    I recently had a visit from a Bailiff and asked to pay £795 for a PCN that had been issued in 2012, the notice was sent to my old address where I had not lived since 2011. The notice was issued on my husbands name, who was not home at the time.
    I was alone with my newborn baby at home and when the Bailiff arrived, I was scared and felt pressured into paying as he said he was going to take my car. I did not know what to do and I paid with my overdraft.

    I had written a complaint to the Harrow counsel, who had issued the notice, in reply they advised I should fill out of time witness statement and write to Newlyn for the breakdown of costs. They also have said that I may not get my money back.

    Any advice on how I can get my money back? I have filled in TE7 and TE9, for not receiving the notice.

    Hae a good read, and if you have any further questions, post them up.

    If you were at home with a baby alone, there is a chance you should have been treated as vulnerable, and the bailiff should have backed out.

      Being a vulnerable, how does this change the situation?

              The bailiff acted illegallly.

              For a start due to the Data Protection Act he/she should have not disclosed the reason for the visit to you, but should have left a letter for your husband in a sealed envelope marked "Private & Confidential"

              To threaten to clamp and remove your car (unless it is registrered to your husband) is also illegal....read theft..

              Do write to the Authority issuing the parking fine, but also to the Enforcement Centre at Northampton County Court, and complain in the strongest terms about the bailiff actions, including their name and the company they work for.

                Thank you for the advice, do I write a letter or are referring to the TE7 and 9 forms Enforcement Centre at Northampton County Court?

                  I received a letter from Newlyn PLC, with the following breakdown

                  council debt £172
                  first letter £11.20
                  HPI ckeck £20
                  visit fee 1: £56.18
                  levy fee1:£72.19
                  enforccement fee 1: £235
                  schedule 1 sec 8 £35
                  cancel tow fee £90
                  card payment 1
                  vat 104
                  total 796

                  THey have attached a warrent of execution but it does not have any stamps but with traffic enforcement c details with correct address.

                  Newlyn has written that they Bailiff did not know that (my wife) I was venerable as we did not contact them before. If we did not receive any of their letters then its royal mails fault. THey written that they have acted correctly with correct fees.

                  They written that their bailiff was certified at the time.

                  They would be happy to answer any further queries.

                  WHere do I go now?

                  DO I write to them andy mention the illegal collection? Will this help to get my money back.

                  I have filled te7 and 9 but yet to hear anything

                    I wanted to add that on their first visit no letter was left behind and the bailiff told me they could not find the car on the first visit. He only noticed on the second visit when I was at home.

                        Also the name of the bailiff and the court in which they were certificated would be good if possible.

                          Newlyns' usual response to this is "we see this a vexatious request".

                            I note that they have charged for an HPI check, which charge is not lawful.

                            falsus in uno, falsus in omnibus as one might say.

                              There's a famous collection company called 'Newlyn'
                              That's noted for charging and threats
                              When asked for the details of their bailiffs
                              Newlyn reply, "Eee! I am vexed!"
