    Hi All

    Im new to the forum as a member but have been browsing and reading post and information for a fair time.

    Ive got myself into a bit of mess and need your help!

    Ive always been told and read that if i go into the congestion zone in London not to pay it as its unlawful! They are not at a loss, I'm not causing them a loss therefore i do not have to pay.
    From the day i got the Penalty Charge Notice, in January, i wrote back appealing the situation advising i accept i owe £60 on the basis they personally sign and date an affidavit i attached. I never got that back.. Surprise! I went on to receiving endless template letters that they are made to send and ignored every single letter i sent. After all the letters they ignored and it was passed to bailiffs, i called they to ask why they had not replied to any of my letters and why i had not received the affidavit back, i knew the answer to that one! Ive just spoken to them again and the man was so rude he did not listen to a word i said, spoke over me the whole time, put me on hold for over 20 minutes and come back telling me the charge still stands and to expect bailiffs who will now deal with it.

    Ive done everything i was meant to, as far as i know! And seem to have hit a brick wall! I do not want bailiffs at my door as i think i will break down haha.

    Any one got any advice on what to do next? Before i crack and pay the £200 they are demanding!

      I would assume no one has responded as it appears you are quoting FMoTL stuff which is usually a load of bunkum. Now it appears that all chances of appeal are passed and it is in the hands of the Bailiff who no doubt is wanting a lot more than the original charge.

        I got some information from there and also some other sources who no all about it. Chances to appeal further are passed and bailiffs are asking just over £200.
        Any advice what to do next?

          Pay up or the bailiffs will take further action and add further charges I would take action against those who quoted this Freeman rubbish get them to pay it

            It's always sad to read of people like yourself who have been taken in by this rubbish. You say you got some of the onformation from the FMoTL sites and some from elsewhere. Would you care to name where the 'elsewhere was'?

            Before having bailiffs unleashed on you, you should have received a PCN, a Charge Certificate and an Order for Recovery. After the Order for Recovery, if the PCN remains unpaid, and no Stautory Declaration is received, they will apply to the TEC for a Warrant of Execution which is then passed to a bailiff to recover monies owed.

            Was this process followed in your case? If so, to be honest, you are best paying as soon as possible.

              I would hope that if you sit back and consider the letter that you sent to Transport for London you will realise that it is nonsense to expect that you can drive into the zone and not expect to pay a single penny and, at the same time to expect that Transport for London will sign an Affidavit (which would no doubt be displyed on FOTL websites) confirming that the charge is illegal !!!

              It is crazy to consider that they are not at a loss. TfL paid millions and million of pounds to set up the Congestion Charging Zone and there are simply endless statutue laws in relation to the charges.

              If anyone is to take as gospel the utter drivel that is given out by Freeman on The Land forums then they are free to do so but they really should ask the simple question which is:

              If Transport for London refuse to sign the affidavit what will then happen?

              Can a bailiff take my car and belonging?

              If they do take my car....how can I get it back?

              Given that bailiff action is pending, I will give you the CORRECT answers which are:



              If TfL refuse to sign the Affidavit...then they will apply for a Warrant of Execution and this will be passed to their bailiffs.

              Yes...the bailiff can take your car and this is the simplest asset to recover in particular given that the vehicle registration number features on the right hand side of the warrant !!

              To get the car back....you will EITHER have to pay an astonishing amount of money to include removal fees or otherwise.....take the bailiff company and Transport for London to court.

                Absolutely agree Milo, and I think you'd probably agree the only way the OP could appeal was if the process outlined in my previous post had not been followed. This is highly unlikely.
