    Hello all,

    I received a letter today from Marston's detailing that I owed the sum of £500.19 for an unpaid court fine. This was a fine that I paid off last year and I have a record of the debit card payments on my bank statement(s). The letter is to my new address (moved around 6 months ago) so this is the first I have heard of any supposed non payment and they have stated that if payment is not made in full within 7 days they will arrive at my house and start to remove goods.

    What is the best course of action here? I have seen in the useful letters that you can request a breakdown of fines/fees of what I supposedly still owe. Or should I just forward a copy of my bank statements to them to show that I have paid the fine in full and leave it at that?

    I tried to call Marston's to discuss the account and was told that unless I was willing to make a payment in full, they were not willing to discuss the account. What I am worried about is that if I send these letters does that stop the bailiff from coming to visit my house?

    Any help or advice anyone can offer would be gratefully received, thank you.

      Contact the court who issued the fine and send proof of payment reminding them that they are responsible for any losses or damage as a result of their enforcement if it is found to be wrongful, as in fine paid and nothing owing.

      Marstons will continue to attend and rack up fees until the court call them off. they will be more than happy to take your car and sell it for their fees, if the court don't recall the probably erroneous warrant.
      Did you pay after a further steps notice?

        Don't forget that Marstons have a history of continuing with enforcement action after fines have been paid or HMCTS have pulled DWs, BB.

          Thanks BB yes I had that in mind when i advised OP to tackle the court, as Marstons don't give a toss who pays, whether someone should pay, warrant wrong etc, all they care about is that somebody, anybody pays them. So the ground needs to be taken from beneath them.
