    Since when have Bailiffs been able to send anyone to prison?
    If this is in writing I am sure if posted up the letter can be commented on by other members and maybe an action can ve taken against the bailiff

      We don't have debtors prisons since Charles Dickens time - http://en.wikipedia.org/wiki/Marshalsea, so how can they send out a committal notice??????

      The bailiff is also breaking the OFT golden rules on debt collecting.... keep those letters as the OFT may just want to see them and they could - SHOULD lose their licence..

        Hi Toobusy,

        I read either here, or on another thread last week, that as of 30 September 2012 (latest figures I could find), there were just 7 people in prison for non payment of CT in the whole UK. When you consider how many won't pay as opposed to can't pay, this gives an idea how rare it is. You are definitely in the latter gategory, and making good inroads into what you owe.

        I've got to go to hospital now, but will be back this afternoon, as per my reply to your pm, and will look back in on this thread then. I wouldn't be worrying about their threats - technically it is possible, but it is near certain it would not happen to you.

          Could you please scan up a redacted copy of the letter you received from the bailiff so I can see it? I'll write a letter for you then. I've got to go back to the hospital this afternoon, but will be back mid to late afternoon, so as soon as you post it up, I should be able to crack on. For your peace of mind, the sooner we can get it penned and sent, the better.

          If you'd rather email it directly to me, I'll clear it with site admin - I don't think there'd be a problem, and I'll pm you my email address. :beagle:

                      The point is that the (rather silly) threatening letter states that the subsequent action may involve an application for you to be gaoled.

                      And pigs may fly out of the bailiff's arse.

                            Don't panic - you are nowhere even near going to prison. As said previously, prison is for people who are deliberately refusing to pay, and have for a prolonged period. That is NOT you. You are paying, and making increasing payments to the council.

                            Newlyn are way out of order IMO sending such a threatening notice as this, and it is worthy of a complaint in itself.

                            I will write something for you, though having already penned one letter which took a long time today, I can't promise it will be tonight.

                            PLEASE DON'T WORRY!!!!!!!! I promise you that even if you were deliberately not paying, you'd still be some way of commital having seen the letter. You are paying and you won't be going anywhere near a prison over this.

                            I understand how distressing it must feel for you, but I have been in the same situation as you are - I didn't go to prison and there was never any talk of it other than from the bailiffs. They are bullies, pure and simple. The letters are designed to try to get you to borrow money you may not be able to afford to repay, don't fall into their trap.

                            Unless someone else is kind enough to volunteer tonight, I'll write a letter asap for you. Don't panic - easier said than done, I know, but please try not to.
