    also sent another email to the reply and got a out of office reply until 2nd september from manager so sent it to the main email address

      Hello, I think they want it all upfront going by the amount outstanding i was sent te other day, just sent a reply to the manager but she's gone away till 2nd so forwarded to main council email

        Sorry, I obviously wasn't clear. Did you make any payments towards this year's CT, or not? If not, that is probably why they want it all up front. If you did make payments starting in April for this year's CT, they should not be cancelling the installment arrangement unless you default.

        Are you making payments at the moment to the council each week?

          Hello, ive just rang up council and made payments, thought they will put it towards my outstanding council tax bill, didnt realise they will b putting that money towards the old council tax and no this years, but i am disputing last years, im making payments on average of £100-150 a month now

            It is for you to decide which year you put payment to & not the Council. You simply tell them which year & what amount, if they refuse ask for the nam & position of the person refusing as they will be responsible for a Formal Complaint to the Council & subsequently to the LGO.

                    got a reply from council basically asking for full details of the complaint and there appointing the bailiff as there agent

                    "no Regulation in the Council Tax (Administration and Enforcement) Regulations 1992 that states you must deal with the bailiff. However Regulation 45"


                    so basically saying if don't deal with the bailiffs they will consider other ways

                    "application for your personal bankruptcy or committal to prison"

                    ive been making regular payments what can afford these have been increasing every month so im defo not trying to avoid the council tax debts just paying as much as can afford

                    any advice would b much appreciated

                      They won't get commital - you're a can't pay, not a won't pay.

                      Out of interest, have you ever sent them a copy of your household income and expenditure so they can see that you're paying everything you can?

                      Have you or your partner got health issues which are being exacerbated by this?

                      Have you ever tried getting a third party to approach the council - this could be your councillor, MP, or an independent FREE debt service (-eg- CAB)?

                      How much is now outstanding on how many LO's?

                        hello sorry for the late reply im defo a cant pay but is payin he's debts off as self employed income is increasing, so im payin more towards the council tax, think its abt £1300 outstanding not includin this yrs or last as wasn't working due to bein on benefits

                        did send them a income statement several months back but got a note from bailiff sayin my offer is not acceptable, so after that didnt bother sendin anymore

                        now everytime make a payment get a bailiff letter threatening car removal/ goods removal in my absence so im just ignoring them,

                        if the council try and make bankrupt doubt it wil go through as im slowly but surely payin debts off

                            Hello, ive been making monthly payments for last 7 months, first 2 months they were for £0-£5 then soon increased to minimum of £100 a month and now rising to average of £75 basically the more money i earn the more i pay towards my debts, nd this being a priority debt its at top of the list, so the council cant say im avoidin makin payments as clearly have proof that my payments r increasin as business picks up, its just such a pi88s8take that everytime a payment is made letters frm bailiff get sent 2 days later they all get "shelved" as dont pay any attention, buts its one stress dont need as its hard enough tryin to make my business work and worry abt bailiffs comin over tryin to bash the door down

                            a letter would be very much appreciated

                              Toobusy - it is unlikely to get done today now, but please pm me with a link to this thread tomorrow and I'll write a letter for you. There are no guarantees, obviously, but it will certainly do no harm.

                                hello, very sorry ive not replied been very busy as business as picked up, so opportunity to earn more and pay more debts off, yesterday got a letter from bailiff saying

                                "commital notice"

                                will be sent to prison as no arrangement has been made etc... again every time i make payments a few days later one of these comes, now I think they tryin to scare with prison tactics just like the lady at the council was, saying i'ii b sent to prison, but as advice on here tats highly unlikely as are paying council off, not avoiding .

                                will reply to your pm on weekend and any assistance would b very much appreciated
