    Hello, I defo need help, im trying to keep on top of my debts and slowly but surely paying them off but its takin time as being self employed isn't easy in the present climate

      this is exactly why i never ever speak to bailiffs anymore, on a previous small debt the bailiff told the court had deliberately tried to avoid payin the debt and they sent a warrant of arrest out thinkin I couldnt b bothered: a complete and utter lie hence why ive been paying the council direct

        "removal of goods notice" magistrates liability order for unpaid council tax
        Unless he has previously levied distress on your goods, that notice is worthless.

        and at the top handwritten "committal proceedings" if no reply or allowed access, call the bailiff not office as the bailiffs decision is final!
        How quaint!

        I dare say that the Court whence his Certificate was issued might be interested in his usurpation of the role of a magistrate or judge.

        Rest assured that no mere bailiff has the lawful power to confine you to gaol and, as for his decision being "final", one might expect every judge in the land would disagree.

          hello, they were asking what times I come and go, what car i drive/ reg number basically the neighbours told them to do one but they keep on hounding them and now there getting sick of it, even though they've told the bailiff countless times they no nothing

          they have or will ever place a levy because wont let them in don't own a car for them to put a levy on and don't have any personal belongings to cover the debt, which ive told the countless times

              Your neighbours should make a Formal Complaint to the CEO of the Council and a copy sent to the Bailiffs. If your neighbours are prepared to cooperate I would also be writing to the Court where the Bailiff is Certificated.

                hello, i dont want to get the neighbours involved in my own financial affairs but they are more than happy to let me state the bailiff has been harrassin when they have nothing to do with the debt#

                      everytime the bailiff has been around the neighbour below as always mentioned it,as once no answer they go to his sometimes he opens and tells them to do one he knows nothing

                        Your case has similarities with a case that occurred in Hampshire, during 2012, which lead to a Ross & Roberts bailiff losing their certificate without a Form 4 complaint being submitted or a hearing. The complainant submitted written statements from their neighbours, confirming what they had witnessed the bailiff doing, plus dodgy paperwork the bailiff had used, plus video footage of the bailiff's conduct, plus a report on the incident from a sergeant of Hampshire Police, who, on discovering the bailiff had lied to them, returned to the complainant's house and threatened to remove the bailiff with the toe of their boot.

                        I am happy to help you with the statements from your neighbours and the letter to the court.

                            Don't put ideas in my head, Charity. The temptation to remove a certificated bailiff with the toe of a steel-toecapped boot is very difficult to resist. :grin:

                              Toobusy its up to you but with the help of others like Bluebottle you can kick up such a fuss against this Bailiff that maybe he will lose his certificate and no one else will have the problems you had

                                If it results in the same outcome as in the case in Hampshire, during 2012, it will certainly shake the bailiff, give Newlyns something to think about and, probably, give the local authority who hired Newlyns something to worry about. Judges don't make decisions as in the Hampshire case lightly.
