I have just received a letter from Marston Group informing me they are in possession of a magistrates court order for non payment of a fine (talking on a mobile whilst driving) I paid this fine by cheque in the post. I called them this morning to ascertain what this was about as this was the first letter I have ever received about this matter? No reminders? gone from a 60 fine to 600 without me knowing at all?? I have moved and stupidly didnt redirect my mail but surely if they have managed to find my new address now they could have done that before threatening bailiffs in 7 days? I am speaking with the bank to get proof the cheque was cashed but the rather unhelpful lady at Marston wouldnt give me any dates or information to assist and will not put a hold on the bailiffs until the matter is resolved? Surely they arent allowed to do this to people? I literally knew NOTHING about this until yesterday and thought it was paid?!?!?!? Is there any way I can appeal? Anything I can do? I dont have £600 and dont feel I should have to pay it anyway??!! HELP!!!!

The maximum Marstons can charge for collecting an unpaid magistrates court fine is £300. They can charge £85.00 for sending you a letter, but the other £215.00 is only payable if they physically attend your home. Charging it upfront is an absolute no-no.
Check with your bank first to establish if the court presented the cheque for payment. If it has been presented and the amount debited, then the Distress Warrant would appear to have been issued in error, in which case, it should be withdrawn by HMCTS, once you present them with evidence that the fine has been paid.

Things to do:- Was the cheque cashed?
- Yes....call the Court and ask them to put the warrant on hold/or withdrawn.
- No....you are in trouble, pay now for the fine and the Administration charge of £85. Thus avoiding the next charge of £215 when a bailiff knocks on your door.
The Court does not send reminders, in their first letter which is the notice of fine and collection order they spell it quite clearly what's going to happen if you do not pay.
It is very likely that who found your new address was Marston, not the Court.
If you changed address and did not have your post redirected then it's no one elses fault, except yours, if somebody has incurred expenses in trying to trace you in relation to an unpaid fine incurred because of criminal behaviour (sounds harsh, but speaking on a handheld instrument whilst driving is a criminal offence)
If the original fine was £60 it could have gone up to £90, the Marston letter should tell you how much the fine is now.
At letter stage the Administration Fee should only be £85, and only if you do not pay/get in touch with them to try and do a payment plan within seven days of the date on the letter a further £215 will be added as soon as a field agent visits you.
