  • bailiff letter hand delivered (council tax )

I woke this morning to banking on the door at 7.30 am I have a small child and the letter was for my husband who was at work ! I opened the letter and it said they had come with intention on removing goods if my husband doesn't pay the full amount !
we haven't had any letters saying that a summons was going to court , surely this should of gone to court first ?
I don't know what to do I can't afford to pay them , do we ring them or the council ?
please help I am so scared in case they come back mainly for my child its not fair for her to go through this ! I have my doors locked and windows and have rung my husband and told him to park his car a few streets away ! what else can I do ? what do I do now ?
Can they take my child's belongings ?

Is this for this years Council Tax or a previous one? Is there any illness or disability within the household? Do you claim any Benefits?

I assume you stay at home looking after children - are they of school age? You may need to get a letter or similar from your GP or other medical professional, you would use this to claim vulnerability under the National Standards for Enforcement Agents . Any letter you send must go to the Council with a copy being sent to the Bailiffs.

There is no law that says you have to speak to or deal with a Bailiff. Regardless of anything he may say or do he has no automatic right of entry to your home. He may threaten all sorts - imprisonment, bankruptcy, putting the children into care - he can do none of this.

However Council Tax is a priority debt and must be paid otherwise the Council may decide to take Committal proceedings against either yourself or husband. Even though you may not be named on the Liability Order you are jointly & severally liable. You should make payment direct to the Council using online banking, Council website or automated phone. This shows you as a willing payer and should be done at the same time each week - £5 every Thursday for example.

              No.

Nor may they seize your child and sell her for medical experimentation.

                  I hoped it would.

Bailiffs are liars and bullies. Please don't let the buggers get you down.

JBW took over from Equita/Ross & Roberts on 1 May 2013 as the contracted enforcement agent for Plymouth City Council. I would advise you to contact Plymouth CAB who are monitoring JBW's activities on this link http://www.plymouthcab.org.uk/campaigns-and-advocacy Click on a "Tell Us Your Story" link and fill in the details.

From what you have said, something has gone wrong as a local authority is supposed to inform you of their intention to seek a Liability Order, the date this will be applied for and at which court. Have you seen a copy of the Liability Order and a copy of Regulation 45, Council Tax (Administration & Enforcement) Regulations 1992 (as amended).

Do you know who your local MP and ward councillor(s) are, please?
