This morning i had a bailiff knocking on my door asking for my fiancee. What happened is my fiancee received a fine for littering over a tear go which he completely forgot about. He has never received any letters regarding to the situation what so evere. We also moved about a year ago and we live in a shared house. The bailiff said that my fiancee owes them £595 which has to be paid now otherwise he will get arrested. We obviously don't have that amount of money and the bailiff is expected to come back in a couple of hours. He said that they've send the letters to our previous address and it's our fault that we don't collect the letters. I am annoyed about the fact that when it comes to the letters they don't know our address but when they have to send a bailiff down they know exactly where we live. The bailiff has been threatening us that my fiancee will get arrested and it can not be paid in monthly instalments it has to be paid now as one of payment. I really don't know what to do now please help

This is a typical Marston tactic and the bailiff has to prove he has an arrest warrant from the court that imposed the fine. It is more likely he has a Distress Warrant which does not confer any power of arrest. If this neanderthal returns, ask to see the arrest warrant. As for the neanderthal telling you the fine cannot be paid in monthly instalments, yes, it can. HMCTS split the fine into six monthly amounts to accommodate situations where debtors cannot pay in one lump sum. You should also be aware that £300 of the £595 he is demanding are fees for his services.
If you could advise which county or metropolitan area you are in, I will provide you with the contact details for the HMCTS Senior Enforcement Manager for your area. They and their staff will be able to put Marstons back in their box, if necessary. Another thing is that Marstons have peed-off a lot of court staff with their attitude and behaviour.Life is a journey on which we all travel, sometimes together, but never alone.

We live in Uxbridge area. I also guess there's nothing we can do atm as it's saturday so everything is probably closed. Is there any sort of complaint i can make about the person threatening us as well?

Your fiance will need to explain that you and he moved home about a year ago and have received no correspondence on the matter and no Further Steps Notice has been received at your current home or whilst you were residing at your previous address. Payment proposals will need to be specified in the email as this will show the SEM you are not avoiding payment. Any complaint about the bailiff's conduct should be addressed to the SEM.
