Does a bailiff need to be certificated for HMCTS distress warrant?

  • Does a bailiff need to be certificated for HMCTS distress warrant?

    Does a bailiff need to be certificated for HMCTS distress warrant? I have received conflicting information on this.
    I had been advised they most certainly do, THEN bailiff claimed he doesn't need to be, AND he can carry out work for 6 months before certificate is issued, BUT then a month on from being advised he most certainly needs to be I received info which claimed indeed he doesn't need to be, and bailiffs can work for up to 6 months uncertificated.

    This site seems to give honest, knowledge advise - could someone please clarify?

    He should be Cerificated but the contract with HMCTS allows for a Bailiff to gain a Certificate within 6 months. This was at the beginning of the contract and by now all Bailiffs should be Certificated to do this work but given the nature of the beast some will rely on the original understanding.

      If the condition in the contract applies at the commencement of the contract, PT, no bailiff and no contracted bailiff company has any excuse now. All bailiffs executing DWs for HMCTS should be certificated. I do know, from having spoken to HMCTS enforcement and court staff, that there is disquiet about the activities of firms, like Marstons, and HMCTS can and have withdrawn DWs from contracted bailiff companies where the contracted company has been caught misleading/lying to HMCTS or some other transgression.

      HMCTS Civilian Enforcement Officers (CEOs, also known as Warrant Officers) are perfectly capable of dealing with fine defaulters/debtors and, in areas where they are used, debtors report that HMCTS CEOs are fair, reasonable and treat them like human beings.

      The case for rescinding the contracts of the four private-sector bailiff companies is growing ever stronger, if some of the posts on LB are anything to go by.

          I'll certainly agree with that but as not one contract has been superseded or renewed then they are sticking by what was arranged initially.

            TBH, PT, HMCTS would solve a lot of problems and save themselves a lot of time going round clearing up after the likes of Marstons, Collectica, Excel and Swift, as well as public money, if they rescinded ALL contracts and left it to CEOs to enforce court fines. At least they are accountable, they being civil servants.

              That is common sense not common purpose so won't happen, the government are wedded to privatising UK PLC

                          Perhaps the demented slaphead needs to be assessed by Atos, as in don't give A toss, and found unfit for work, and be forced to claim ESA.....
