    hi im having problems with collectica, I got a fine for £155 from the courts and paid it to the courts in 2 instalments my second instalment was 2 weeks late this was back in march when I paid it, I thought nothing of it till I got a hand delivered bailiffs letter from collectica last week (pushed through the letter box) they didn't even knock on the door I rang them up and they said there was £80 outstanding from my fine and I now have there charges of £300 added on top, I knew I had paid it so got in touch with the courts they had a record of me paying it but it wasn't added to my account they traced the payment as it was added to the wrong account so my fine had been paid off, but because it was 2 weeks late in the first place they had already instructed collectica, so this is where all my problems start......... collectica said they sent me a letter out on march the 10th demanding the £80 (missing payment) which I never got as I would of rang them straight away knowing I had paid it on the 1st march (to the courts) I tried to explain what had happened with the missing payment they said they got notified by the courts last week that it had been paid but they are still demanding the £300 fees as the bailiff had come to the house which he said they knocked but got no reply (they didn't knock) my husband watch him sneekly putting the letter though the letter box my husband thought he was a leaflet delivery person and if he had knocked our 2 dogs would of gone beserk, does anyone know where we stand ive already phoned them and told them they are not getting anything and not getting peacefull entry

    Collectica are not exactly forthright in their way of doing things where HMCTS are concerned. If you suspect Collectica are not being entirely frank about their version of events, you will need to contact the HMCTS Senior Enforcement Manager for the area in which the court that imposed the fine is located.

      I am afraid that the fees to Collectica are payable.

      As soon as you were late with the last payment, the Court classified you as a "defaulter".

      They would not write to you because the terms and conditions of your delayed payment agreement would have been sent to you with details of how, when and how much to pay.

      Once you default the Court will pass the job of recovering the money to the Bailiff Firm they have a contract with, in this case Collectica.

      The Bailiff Firm will then send you a letter remind you that you missed £ XX.XX payment to the Court and now you have seven days from the date of this letter to pay £ XX.XX plus £ 85.00 administration costs.....the letter is also very specific, if you do not get in touch or pay within the 7 days time limit a field officer will visit you and this action will add a minimum of £ 215.00 to the bill.

      As the compliance letters are sent generally second class you have far less than 7 days (if does annoy me) and since there is no proof of posting (and this annoys me even more) you can not prove that you never received a letter....let's face it, you are the one who owes money who is going to believe you that you just didn't thrash the letter in a fit of anger for being caught out.

      On the other hand, since the Court did not allocate the payment to the right account, I would argue that I only have to pay the £ 85.00 admin fee......but the argument is with the Court not with Collectica.

      My advice is to pay the £300 to Collectica, gather all the evidence you can and ask the Court for a £215.00 refund.

      Please do take note of this......the fees are part of the money to be recovered via a Distress Warrant, which means that even if the fine is paid the bailiffs still has all the powers that a Distress Warrant gives them, including forced entry if necessary.

        Sir Vere is correct. I would argue with the courts first that you should only pay £85 rather than pay and then try to reclaim, but otherwise I concur.
