  • How to reclaim over-payment from Bailiff / Court for parking ticket

    Hi Can anyone help please?

My wife paid a bailiff while I was away visiting my sick mother in hospital in wales for an unpaid parking ticket from 7 months ago (that we didn't realise we had)

We hadn't heard anything about it prior to the bailiff turning up yesterday threatening to take her car in payment?!

He gave her a "warrant of execution - unpaid penalty charge" which states that the amount due (including court fee and any adjudication costs) is £82.00.

But the bailiff asked for £379.77! - She said she would have to get money from the bank and he said he would come back - the long and short of it is that she paid the £379.77 in cash and got a receipt!

What can we do as reading some threads on here its overcharged by the bailiff surely? We honestly didn't even know we had a ticket - we would have paid it the same day if we had!

What can I do if anything about this? We cant prove that we didn't know anything but we didn't even receive any letters afterwards surely we should have done?
The Bailiff told her to claim it back afterwards and that a lot of people do?

    Thanks

Was the address on the Warrant the current address where you now live? Was there no ticket on the car originally?

      Yes.

First, read the "sticky" notes on parking penalties ---> link

The bailiff should have demanded only £115.60, so he has certainly overcharged.

An "out of time" appeal should result in the monies being refunded.

Which council issued the penalty and which bunch of bailiffs were involved?
