    Hi everyone,

    just saw this on BBC News online. http://www.bbc.co.uk/news/uk-england-london-22993060

    Newham have been using two unlawful cameras. I guess if anyone has had to deal with bailiffs as a result of these PCNs then thats all unlawful too?

    If the tickets issued were unlawful, the fines already paid MUST be repaid, regardless of what Newham Council contend. Accordingly, any warrant issued on the weight of an unlawfully-issued ticket would be invalid and subsequent bailiff action would not be unlawful, but illegal. Whatever happens, Newham Council is in serious trouble and any goods bailiffs have seized and sold will be regarded as stolen goods and must be restored to the persons from which they were taken, which means Newham Council and any bailiff company they employed must take immediate steps to recover any such goods. Newham Council is being very foolish by arrogantly asserting they don't have to refund unlawful tickets that have already been paid. Now the cat is out of the bag, they have to face up to the reality that those affected have a valid case to serve litigation on them. And those affected are likely to win.

      Not looking good if someone lost their job due to the council bailiffs towing and selling a motor then. Something similar in Westminster regarding unlawful cameras if I remember correctly, have to trawl nutsville to have a butchers.

        If that has happened, BB, then, IMHO, anyone who has suffered loss of employment due to the unlawful/illegal actions of Newham Council and any bailiff company it has employed may well give grounds for an action for damages for loss of income due to the council's unlawful actions. Plymouth City Council has recently been hauled over the coals regarding the legality of a bus lane camera. They ain't happy bunnies, but, hey, that's what comes of not dotting the 'i's and crossing the 't's and checking the lawfulness of what you are doing. What's the saying, "Act in haste, repent at leisure." Should be branded on the forehead of every local government officer in the land.
