Hi , Can anyone please direct me to a site where I can print of law that says bailiffs can only charge once for a visit and not per liability order. I have wrote to them and they have took some charges of (as a good will gesture ) is how they put it but they are refusing to take of charging me for 5 liability orders but only one visit. They have also done a levy on a car that's not mine so I will contest that. The other one is they say they can charge me the Schedule 5 Header as this is a redemption fee . This is the fee on 4 orders that they say have been removed as a good will gesture but it will remain on one order as this as been correctly applied. Thanks for any help that you can give me. I have reposted this in this thread as I put it in the welcome page by mistake. Jacobs have now told me it is up to me to prove this car is not mine by writing to DVLA and getting proof. is this not up to them. The lady the car belongs to know what they have done and given me her paper work from motability. My name is on the insurance to drive as I care for this lady full time. does this make any difference ?

Re: baliffs charges and wrong levy please help
What bailiffs are these please, they cannot levy a Motability vehicle so the levy and all associated fees MUST be removed along with the head h as the levy is unlawful, no goods capable of being taken have been removed and offered for sale, therefore cannot be redeemed. Point them in the direction of the Local Government Ombudsman's report into Blaby Council and Rossendales where multiple charges were ruled wrongful:

Re: baliffs charges and wrong levy please help
Its Jacobs Do I have to send details of proof that I don't own the vehicle. When I told them I didn't own it they said I have to proof it .I then said when I do are you going to remove all charges and she just said we may look into it.

Re: baliffs charges and wrong levy please help
Can I print the report into Blaby and send it into Hyndburn council as Jacobs have said that they were right in charging me on 5 lilabilty orders even though they only came twice ( they charged 5 times for the 2 visits ) so the charges will standthanks

Tell them to do a simple DVLA check which should show Motability listed.Originally posted by cr2556 View PostIts Jacobs Do I have to send details of proof that I don't own the vehicle. By all means send it. At the same time involve your local Councillor(s) and send copies to them.Originally posted by cr2556 View PostCan I print the report into Blaby and send it into Hyndburn council as Jacobs have said that they were right in charging me on 5 lilabilty orders even though they only came twice ( they charged 5 times for the 2 visits ) so the charges will standthanks

Re: baliffs charges and wrong levy please help
Jacobs are a particularly nasty bunch and will clamp first and ask questions later, however you are merely a named driver and she is leasing the motor, the tax disc will be a zero VED disabled one so if Jacobs were to clamp or interfere with the car they would be on a very sticky wicket. You can quote the Blaby council findings to them also, perhaps Throssell v Leeds City Council 1993 where multiple fees at the same time were ruled out of order:Originally posted by cr2556 View PostThank you for your reply I will start to do the letter now. Lets hope I can convince council or Jacobs. I don't hold out much hope with Jacobs though.
"Turning to the taxation it seems to me that notwithstanding the fact that there were three liability orders but one visit was made by one bailiff and the maximum that the council's reasonable charges can be is the result of applying the formula contained in Sch.5 para.2(1) b) of the regulations."
