    The message you want to write is superfluous and will not aid anyone.

    He must contact the originating Court and tell them he has no knowledge of any of this - until the Bailiff turned up that is. Which Court is it I hear you ask, that I don't know either but a good starting point is to contact any of the Maistrates Courts within NW London and ask for help. When you get the right one he needs to be able to be allowed to swear a Statutory Declaration that he knows nothing which if granted winds the whole process back to the beginning and at the same time gets shot of the Bailiff.

      Okay, he will have to send am email to them - I have taken this up because a) i do not want anyone rocking up to my home b) he is a technophobe with computers and stuff like this. :-)

      So, a final question then so that we can get the email composed -

      What should he ask?

      I know he should also tell them what address to use going forward but I want him to be sure he is asking the right questions up front.

      Also, was there any further advice of the content of the letter given that is was not on behalf of HMCTS or similar?

          All he needs to ask is which court issued this and what is it for?

          After that he needs to go to the issuing court and swear the Statutory Declaration mentioned above to say he had no knowledge of this until now.

            Once he has done that, all action should cease allowing him to sort it. You are NOT the debtor but Collectica will hide behind DPA whilst still threatening you to get you to pay a third party debt, as they have your address for him.

              Your query is very common indeed and all that is required is for you to contact the court and ask to be allowed to file a Statutory Declaration. The court will then advise the bailiff company to cease enforcement to await the stat dec being completed. All bailiff fees be be cancelled and if the relevant government agency (TV Licensing, DVLA etc) wishes they can issue a NEW summons so that you can either pay at an early stage.....or defend the action.

              You must contact the court TODAY.
