  • help needed with bailiff threat letter

    Hello all i hope everyone is well and having an enjoyable week the weather is certainly helping.

    i met with a Bailiff on my doorstep early yesterday who said he was from the council lie number one saying that he had come to make arrangements with me to pay outstanding debt for council tax. i said that i was busy and that he would have to come back another time good job i did as he then handed me a letter which i read later and found out he was a bailiff not from the council bet he has caught a few people out with that one.

    am i right in thinking that as soon as they gain entry that is when the fun starts as in they make an inventory and such like. anyway the letter states that i have 24 hours to pay up or how i can make arrangements to pay thing is i dont trust them at all. if i make an arrangement for the bailiff to visit my house am i not losing my rights also by this state it says even if i make arrangements i will incur a statutory fee just for speaking to him and i must pay a minimum payment of 50 pounds if this legit?

    i think my first port of call is to ring the said bailiff Jacobs btw and ask for a breakdown of costs and i need to check the bailiff current valid bailiff licence that should keep them at bay for a couple of months at least or it did the last bailliffs i dealt with back in the day they never returned funny enough. these bailiffs seem to be trying different tactics.

    all i want to know is can i still refer to the council or is it too late as they have gone to court and proved i am liable for the debt apparently.

    any help gratefully received at this stage

    Yes and, although they are supposed to leave when requested, they never do. Unlike vampires, bailiffs are not (usually) repelled by a crucifix, sunlight, garlic or Holy Water - so keep the buggers out! Lock your doors, latch your windows and secure any ladders. If you have a motor car, put it in a garage and lock it in there. Jacobs's bailiffs love to levy distress on motor cars and they don't really care if it has never belonged to the debtor - they'll levy on it anyway just so they can claim their fees.

    Good. I wouldn't trust anyone who gives one written proof that his company are liars.

    What rights do you suppose you might lose by inviting the momzer to visit your doorstep?

    No, that's more twaddle.

    The council drones will say they cannot stop enforcement action, but that's also stercus bovi.

    You should phone the council and ask:


    1. How many Liability Orders they have against you?
    2. The dates they were obtained?
    3. The addresses they were for?
    4. The period of time each covers?
    5. How much each one was for?
    6. How much is still outstanding?
    7. The dates they were passed on for enforcement?

      i believe the dates are from this year jan to date as that is when i started work and i know it is foolish but did not get around to setting up a direct debit which i have now done though hope this will be enough to keep the wolves at bay.

      i know my rights to the extent that no one can come into your house unless they have a prior arrangement with the householder and in legal terms it is only legal to come to your doorstep to ask directions. so the Bailiffs can do one as far as i am concerned i will just phase them with some bigs words and they will hopefully disappear like i said ask them for a valid Bailiff licence and a breakdown of costs that they are saying i owe should see them off whilst that gives me time to plead my case with council. i think what i will do is just over pay them every month to cover arrears and they will soon come round. just gotta keep the bailiffs at bay though. i dont care as i am at work most of the time but it is my son i worry about he worrys they will come and take his xbox and tv that is what upsets me.:tinysmile_cry_t:

          my son is 17 and although he says he is ok i had to tell him because if he goes out i want to make sure he locks the doors etc as i dont want them coming in house when i am at work i sometimes work nights and i cant expect my son to stay in and not go out. i have told him to be extra vigilant and not answer the door unless he knows for sure who it is via text message they at door. what a way to live huh.

            Julie, you have no obligation whatsoever to deal with bailiffs over Council Tax. As long as they don't gain a levy inside or outside (like your car!!!), just don't let them in and make your payments to the council using their automated telephone service or online payment service. You will be liable for £42.50 bailiff fees maximum.

            Post up answers to Clever Clogs' council questions asap if you could please.

              The other question - which you seem to have answered above but of which I'd like confirmation - is whether or not you are single/divorced. It may seem a bit intrusive to ask, but it may suggest you are considered "vulnerable".

                i dont mind you asking as there is a good reason i am single which does seem to imply i am vulnerable. what difference does that make when dealing with these people, they like to go for the vulnerable dont they i am just glad that i am not a little old lady on her own or something.

                anyhow to answer your other questions as best i can

                they have one liability order which appears to have been passed on to bailiffs very recently may/ june time outstanding amount 857.43 although bailiffs are saying it is 625.22 + costs this covers my current address and it is from Jan to May this year

                  It is still worth a phone call to the council to double check.

                  After that, don't have anything to do with the bailiffs as per my post above, and ensure they don't levy on anything outside. You can hopefully stomach the council tax debt plus just £42.50 bailiff fees.

                  If they try to charge anything unlawful, we can then challenge these with bailiff company and the council who are vicariously liable (jointly liable) with the bailiffs.
