  • Ctax Bailiff Threatening Action

    Can anyone please tell me if there have been any changes in Council tax bailiff law in the last 6 months or so? The reason for the enquiry is because I have just had a call from someone who has just been told by a bailiff that he is coming around with lock smiths later this afternoon to gain access to the property to start removing goods. The debtors had paid the balance to the council of £120 after the 1st & 2nd visit. I know they are still liable for the visits of £42.50. The debtors do not have a car and there is no reasonable access to the rear of the garden. The bailiff has never been in the property and no walking possession has ever been made out. The bailiff has told the debtor by phone that he has been to court to get permission to remove goods and because of that the debt is now £178 from £42.50. He has also said that if the sum is not paid by 5pm then he will return with a van and a lock smith and this will take the bill to £300. Have the laws changed? Or is Mr Jacobs just up to their usual drivel.

    I suspect this is a threat - shame it wasn't recorded! A simple way to find out is to phone the court and ask them.

    They do need to pay the £42.50 for Visits 1 and 2 though, otherwise this will continue to happen.

      He rang him back and got a recording. Billy the Bailiff then said that if the debtor pays £42.50 then the debt will be clear. At least the debtor now has proof of what he has said.

        It was threats then - it's always best to pay the legitimate fees to get them off your back. Obviously fees should be checked by anyone unsure, as many bailiff companies continue vastly to overcharge.

            What I would suggest is that they ask at what Court said Bailiff is Certificated at and write to the Court with a brief history of what transpired and ask the letter be left on file so it may be considered at Certificate renewal time or in conjunction with any other complaint about the same Bailiff. Copies should also be sent to the Council & Jacobs
