  • Hello

Hi .....this forum looks like its going to be very useful . I've just posted on a thread started by another newbie . My girlfriend is totally rattled by an unannounced visit by JBW .....her daughter was in the house alone .

are they within their rights to demand a payment by 22.00 hours tonight ....?
Both girlfriend and daughter are distraught.

    Any help would be great.

        Hi Charlton Man,

I must apologise. I asked you to start this thread and then got totally sidetracked. I hope you are getting some sleep as I type this.

How old was the daughter who was in the house alone?

What did the bailiff do on finding the daughter there alone?

        What fine is he enforcing?

No, they can't demand a payment by tonight.

Do not let a bailiff into your house at all. This may help you:

It's hard to advise without knowing more history, so if you could post that up, then we can start helping properly. Do not worry - don't let them in and remember that their common method of operation is to try to scare people into paying.

Don't pay anything without checking on here first.

This link has a list of stickies at the top. One of them is likely to relate to your situation and should answer most questions, but come back with absolutely anything. Just remember bailiffs lie and cheat to get their money, and often their charges are vastly over what is lawful.

morning, and thanks for this, really helpful. the daughter is 17, and the bailiff just gave her a letter and told her to get mum to call him by ten o'clock. when she called and said she didnt have money to pay what was being demanded, she was told to get a friend or relative to pay on her behalf. he said he woukdnt go back to the house that night but could be bsck as early as 6am .mum is at work today, and daughter is at home on study leave. what's the best way to proceed please.

it relates to a parking fine for the london borough of bexley. the original fine was about £120 but when they handed it over to JBW the demand was for £400, after paying £50, but not able to make any more payments they now demand 733.

            Re: Hello

You need initially to file a Statutory Declaration (Out of Time). The link below explains how to do this:

            http://www.legalbeagles.info/forums/...rking-Offences

This at least buys you time, even if not successful. Simultaneously send Letter 1 from the link below to JBW:

            http://www.legalbeagles.info/forums/...Useful-Letters

This will get you a breakdown of the bailiffs fees so we can ascertain which are lawful and which are not.

I am assuming this is a Penalty Charge Notice and NOT a Fixed Penalty Notice issued by the police. If an FPN, post up as the procedure is different.
