  • Bailiffs did/didn't visit?

Can anyone give me advice please? Collectica are charging us £215.00 because they say they sent bailiffs to our house. We did not have bailiffs! They did not visit and no paperwork was put through the letterbox, however, Collectica say they have gps evidence and photographic evidence. When we asked to see this evidence we were point blank refused! Someone on the phone "described" the photograph taken of our door as white upvc. Our door is wooden!! When we continued to dispute that they had been they then said it is of no use to argue, just because they didn't attend the correct property doesn't mean we don't have to pay! Is this true? Do we have to pay £215.00 for a bailiff that can't even be bothered to do his/her job correctly?

    Hi Soozi,

Can you tell us a bit more history about this debt, and what the bailiffs and yourselves have done to date please.

    Thanks :beagle:

Its a speeding fine that my husband "forgot" about when we moved house. It went to court and my husband was ordered to pay £20 a week. He paid it every monday but then missed a payment. Subsequently Collectica set the bailiffs on us!! We are not disputing that we owe the fine or the payment was missed but if we are charged for the bailiffs visiting then we expect them to actually come to the house as they are paid to do!!

OK - I think I can see what they are doing here, but they seem rather foolishly to have missed a step.

          Have a read of this:

          http://www.legalbeagles.info/forums/...s-Courts-Fines

You will see the £215 there quite clearly, but they are not claiming any £85 prior to that.

I would write to them with Letter 1 from here:

          http://www.legalbeagles.info/forums/...Useful-Letters

You can then check the certification of any bailiff being used and see exactly how they are claiming you owe this money.

It is hardly difficult to understand why he went to the wrong house...

It can't be easy to see where one is going if one's head is stuck up one's own backside.

Thanks for your help. We did not receive a distress warrant at any point, in fact we have had no correspondence from them since March when we received a letter confirming payment arrangements.
