If any of you members see a sign NO PARKING ignore it and park there, it is a notice.

Now lets forget about pepsi freeman on the land (very odd) theory, place a NO PARKING sign on your gate, now when someone parks there and pops in the field for say mushrooms and you need to go shopping, this car is parked and blocking your exit out. You can either call police who will probably tell you its a civil case, now take a photo of that car parked up blocking your exit which has a notice on the gate NO PARKING. Now what was your photo taken for? Thats it, evidence, now lets say you take the car owner to court and judge says do not park there as there is a notice, case won, but he could park there again (especially if the car owner doesnt like you), Now try adding this to your NO PARKING sign, NO PARKING £100 CHARGE FOR ANY INCONVENIENCE CAUSED.

What will the judge do now? Accuse you of being a freeman on the land.

Here's another one, next time you get a notice from a debt collector or bailiff, send them a letter stating their freemen of the land pepsi said so, if you owe money to councils or courts go directly to them and pay them, if they refuse and say it in bailiff hands tell them you wont do business with bailiffs, offer to pay again if they refuse then good, dont pay it. Good idea to record every call you make.

The bailiff just called me telling me that I can clear the payment today for £467.84, to which i replie..
That won't be necessary I have already paid the £80.44 declared to me when I was first served this notice.. i have also sent a letter to the county court in regards to this matter and have filled out a statutory declaration out of time form as the payment for the initial offence has already been paid, in addition to forwarding everything to your offices at equita.. his reply was.. ok I'll call you back

I haven't heard from him yet, i feel i have dealt sufficiently with it but feel he may show up anyway..

Anything else I need to do or comments on what has been done already.. please note i made it absolutely clear to both parties that i paid the agreed fee with equita before any contact was made with this private bailiff!

This is what you need to do, there will be no criminal damage caused to the clamp (if attached), no theft and this is due to your warning sign it is now a civil case in your favour. Doctor or no doctor the bailiff dont care he wants your cash. FIGHT BACK

I am removing your right that you may think you have to attend my property (your address) now that you have been warned i must state that should you attend my property in the future it will be aggrivated trespass which is a criminal offence, also, should you ignore this warning i shall charge you £1000 payable in 28 days.

and of course there is no difference between a bailiff and a cold caller. A bailiffs first call is not "cold", if it was it would be unlawful.

The council would hand over the debt to the bailiff he then takes it upon himself to collect using well worded letters and intimidation and what have you, you can then remove the bailiffs right to enter your property after his first attendance. Those that are behind with council tax would be better off going direct to council.

The council told the bailiff to come collect a debt, you the property owner told him no go away, is the council now interfering with your family life by using a 3rd party, if the council has that much power the bailiff would kick your door in or get a locksmith and siez your goods, the bailiff has no more power that your next door neibour does.

What your really saying is the bailiff has power only to knock your door, thats it, unless you invite him in or he walks in, you can stop the bailiff.

A Debtor can remove right of implied access by displaying a notice at the entrance. This was endorsed by Lord Justice Donaldson in the case of Lambert v Roberts [1981] 72 Cr App R 223 - and placing such a notice is akin to a closed door but it also prevents a bailiff entering the garden or driveway, Knox v Anderton [1983] Crim LR 115 or R. v Leroy Roberts [2003] EWCA Crim 2753

Why are you advocating using the withdraw the right of access

No doubt the bailiff will return the warrant/liability order back to the local authority

WITH ALL THE INFLATED BAILIFF FEES ATTACHED AS WELL

The council will then go down the civil court route to collect the council and bailiff debt together

Why are you posting advice that will cause harm to people asking for help

I have no time for this free man stuff when it will end up costing huge amounts and costs if a case goes legal against the person asking for help
