  • Urgent bailiff advice required!

    Good morning,

    This is my first thread, but am sick of being used and by incompetent debt collectors.

    I received a letter from Equita on the 22nd May 2013,dates itself at 15th May, in regards to an outstanding fee that needed to be paid for a pcn. I asked for the pcn number and the amount i owed to which the reply was £80.44. I asked if i could call back that evening in order to check on the pcn to which they agreed.

    Much to my delight, i found the payment confirmation receipt to the pcn in question and called Equita back to inform them. They asked i get in touch with redbridge council asap, and so i did. I also sent a letter to them in order to find out what the extra charges are for. Up until even today i haven't received any reply from them at all. Nonetheless having scrutinised my payment myself it seems it may have been late.

    I then called equita back a few days ago and they informed me through an automated message that my case had been forwarded to a particular bailiff. I tired contacting him to no avail. However, i finally got through yesterday and asked to pay of the £80.44 charge. He was quite stunned and replied that's not right ill call you back in a couple of hours. I remained sceptical at this point, and didn't hear anything back from him. I called again a couple of hours later and still no response. I called Equita once again and got in contact with an operator who rudely and abruptly told me all payment discussions have to be made with the bailiff.

    I then realised that something is a little while off about this situation and so took the initiative. I paid the outstanding £80.44 online to Equita. This payment therefore was paid yesterday before any bailiff contacted me (as i contacted him) and before a received any correspondence about paying off his extortionate fees.

    I am a first year doctor, and need my car for work, so am desperate for it not to be levied.

    I really need your help as to what to do if the bailiff comes to my house or calls now and also how can i rid myself of the fees based on what I've done so far.

    Please help urgently so I'm well word equipped to battle this.

    Contact Equita and tell them you have paid twice, and give them details, if they call show the bailiff the receipts ,but DO NOT let him in, better still scan them and email them to Equita stating you consider the matter closed.

      Thank you for your prompt response..

      I have written a letter to equita, as they are so abrupt on the phone, i suppose my question here in lies with the fact that considering the bailiff has not visited nor contacted me about payment yet, when he tries to how do i prevent him from trying to levy my car especially, as i didn't plan to let him in anyway!

        Park your car away from your home if you can, and contact the council if it is a council PCN with a complaint to them regarding their agents Equita chasing for a PCN you have paid for twice.

          Dear Sir/ Madame,
          I am writing this letter to you in regards to bailiff ref: 14451771.
          As of today 2nd May 2013, at 4.50pm I made a payment for the outstanding balance of £80.44 in regards to PCN: AF65572318.
          Now firstly, the fee to Redbridge council for the PCN was already paid on 11th January 2013. However, as always their incompetence has lead me to you.
          I received your formal notice on 22nd April 2013, itself being dated as the 15th April, called your offices and was asked to make a payment of £80.44. I informed staff that the PCN has already been paid, to which they agreed for me to call the council and organise proof with them, as shown here:

          From here Redbridge, have taken their sweet time in wasting my time, and so to put an end to all of this I called Equita offices back to make a payment, and apparently in the space of a week, my case has been forwarded to a bailiff by the name of Andy.
          Having got in touch with Andy this morning, I asked to make the payment to him of £80.44, to which he replied, unconvinced and reluctant to agree to the fee, that he’ll call back in a few hours. He did not and so I called him back myself, but was still unable to discuss my payment with me. I then again called Equita in order to discuss this payment, but was abruptly and rudely cut off and told all payment discussions should be made with the bailiff.
          Unfortunately, for you however I have yet to be seen by any bailiff nor have any provided notice of further action. And so as you all are waiting on the other to provide me with information, in an attempt to waste my time and money, I have taken the initiative and paid the outstanding debt as originally due:

            Is there anything I can do to prevent the bailiff from attending my house and asking for his extortionate fees. Equita will not let me settle the matter with them, and having just called Redbridge council initially the late fee was for £37. They then passed it on to Equita, who have no passed it on to collector who will charge his fees, even though I have already paid what they requested. Thank you

              This is what you need to do, there will be no criminal damage caused to the clamp (if attached), no theft and this is due to your warning sign it is now a civil case in your favour. Doctor or no doctor the bailiff dont care he wants your cash. FIGHT BACK


              WARNING/NOTICE

              I am removing your right that you may think you have to attend my property (your address) now that you have been warned i must state that should you attend my property in the future it will be aggrivated trespass which is a criminal offence, also, should you ignore this warning i shall charge you £1000 payable in 28 days.
              I also warn you that anything you attached to my vehicle shall be removed and a handling fee of £50 will be charged and a storage fee of £30 each day or part of it, also that if you attempt to remove my vehicle or actually do remove my vehicle you will be charged £5000 plus £100 per day until my vehicle is returned.
              Please read this warning again as it means what it says.

                      If anyone is having problems with bailiffs give them a call and state that you are recording it, now tell them that warning above with charges attached, make sure you get them to hear how much you will charge them, be nice and polite.

                        Yes, after you send a notice then you have protection from harassment, aggravated trespass and so on, fraud, deception etc
