    (please forgive me my English is not very good )


    ok it all started a few years back when someone started using my identity, i kept on receiving train fines for journeys i never took, i wrote to the train companies explaining that someone is using my name and most of the fines where written off. one time i came back from a trip and i found a fixed penalty for drunk and disorderly in a public place so i contacted the B.T.Police and explained to them whats going on,i was told to bring proof that i was out of the country which i did and i thought the matter was closed. i recently moved from Sussex to surrey and i received a letter from LONDON South and Central Courts with tittle (NOTICE OF TRANSFER OF FINE) so i went there and made a statutory declaration for 4/6 fines i had, the other two fines i had to go to another magistrates court for original cases to be heard but i dint go because of a very personal reason.

    Now i have a total of £1035.40 that i need to pay to COLLECTICA, i phoned them up three times explaining but everyone is so rude and threatening, one woman from them came to my house the other day a delivered a letter titled NOTICE OF ATTENDANCE so i emailed them twice waited and waited no reply then i rang them and the guy keeps insisting that i have to pay them £70 a week, we spoke about it but i never agreed to £70 a week it a shock that i got this letter saying that i did and i have to make payment starting 08/05/2013.

    first of all i make around £180 a week from my job and £90 of that is my rent £35 is a loan repayment which leaves me with £55 to leave on the belt can not get a tighter than it already is.

    I am willing to pay because i have had enough but i cant pay £70 a week its too much.

    Although this is not my area of expertese, I would make an official complaint to the police. I would also drop Collectica an harrassment letter, http://www.legalbeagles.info/forums/...assment-Advice+ advising them in no uncertain terms that this debt has absolutely nothing to do with you and also do not sign in your usual signature, there are several letters in this thread so pick one that suits your needs plus add that this is NOT YOUR DEBT and if they continue to harrass you your will report this matter further.

      It is up to the numpties at collectica to prove you are the debtor, do yopu have any idea who may be passing themselves off as you? I would do as Tuttsi suggests and send a cease & Desist letter

        Ok I will check the letters now. I've lived in a lot of shared accommodation its ability to had to know who.

          Your initial post is a bit confusing. Do you personally owe for these fines and if so what are they for, when did they occur, how much was each one for, did you attend Court etc?

            He claims he is a victim of identity fraud, as in others using his details or giving his name Op has never personally attended court but if I understand the initial post correctly, is going to pay up to get Collectica off his back.

              i have two outstanding fines £377.70 and £657.70 which i have to start paying from next week Wednesday at £70 pwk i cant afford that. one of these fine is for a drunk and disorderly and i can prove that i was out of the country.

              the fine went from 442.70 to £ 657.70

                    Can you not go back to the BT Police who you thought had written off the fines? They should have records of what happened and be able to explain what happened and how the fines ended up at the courts. It would appear that either your proof was insufficient for them or there has been a mistake. Either way, it would appear to me they should have the answer. Once you know that answer, you can decide what action should be taken.

                      I have spoken to the BTP before many times and am referred back to courts because it's fixed penalty. This person was arrested for drunk and disorderly at Brighton train station put in the cell over night and in the morning gave my details, police issued him a fine by the time I found out about it the fine had gone from £80 to £120. That's when I took in my documents to that police station, the officer photocopied everything and said he would pass it on.

                        And then what did they do? It doesn't sound like they said they were cancelling the fines at any stage. Did the documents go to the court? Were you advised of a court date or was the ID thief using a different address? Have you filled out the relevant forms to get action halted?

                          If this person who gave your details was in a cell overnight they would have fingerprinted him. So it would be easy to see if your fingerprints match those of this person who is posing as you and this should help you get this sorted.

                              Yah police have all this including his DNa, but because I had never been arrested before all that was put under my name and because of some law police couldn't show this persons picture.
