    In my view the Legal Adviser is wrong. You should attend the Court and ask to make a Statutory Declaration which should then enable the case to be reopened. Do you have any proof of when you moved - bank statement, utility bill, Council Tax bill etc.

      I don't know what to do about going to the court as it's a 2hr+ bus trip and I have a toddler who doesn't travel well plus I don't have any spare cash (or anyone to look after my daughter as partner works or to give us a lift) I can probably get bank statements that show the different addresses but everything else like JSA letters/Dr's etc I don't have anymore.

      Just had Marston round again,he didn't knock on the door just shoved a Final Notice letter through the letterbox that says I have to pay the full amount (550) or they will come back "next week" (no date or time when) to remove goods, my partner was so annoyed he followed him back to his van and told him to leave us alone.

      I am so sick of this idiot, I have told him I cannot pay the full amount!
      I cannot cope with this it's starting to make me ill, why will the court not do anything, why are they fobbing me off when they have messed this up! My partner has had a massive argument with me as he thinks they will take all our stuff next week and there's nothing I can do about it!

      The address where we didn't have a license we haven't lived at since about June 2011,
      since then we stayed at my partners brother's flat for a year then due to some personal problems my bother in law needed to move back into the flat so we were made homeless and were in 2 temporary emergency accommodations and staying at my parents until we were offered a housing association house 6 months ago (where we are now), so we have moved a fair bit. I just don't get why the court seem to think they have don everything correctly!I never knew about the debt until Marston started showing up.

      Oh and CAB don't come here until Tuesday next week (we don't have a CAB office just an out reach thing)

      Is there anyway to do a Statutory Declaration without going to the court? I found this (hope its ok to post other links)

          Did you tell them you did. From what I read on here you informed them on 1 May when you did your original letter which it looks as if they decided to ignore despite it having been signed for. Who have you spoken to at the Court?

              Hi thanks for the replies, sorry if I went off on one I'm just so frustrated and upset by all this nonsense! Here is a quick breakdown of it all:

              * The first point of contact with the court was a letter that I sent dated the 17th April (this was to find out what the hell Marston were doing contacting me as nothing they sent/given me said what the debt was only that it originated from magistrates court, and I had no knowledge of it)

              I then got a letter back from the court (dated the 18th April) with a Memo of entry to say that there had been a hearing on 25th November 2011 regarding TV license and I had to pay £250 in fines~
              The address they had on the memorandum was one I now haven't lived at for 2 years and moved out of 5 or so months before the court date (25th November 2011), I know this because we moved out on my partners birthday which is 18th June and my daughter was born 31st August 2011 and we were living at my brother in laws flat then.

              ** I then sent another letter (30th April by rec post it was signed for) asking the court to take the debt back as I hadn't received a court summons or further steps notice and to tell them that I had Marston harassing me for money etc..

              Waited and got no reply so sent another letter (again rec post was signed for, sent on 13th May) this was a new letter (with a copy of the previous one attached) but still along the lines of the first emphasising that I hadn't received summons etc.. and that I hadn't lived at the address since June 2011 and they could check our benefits/bank/Dr's/Hospital etc for address changes and asking them to take the debt back and again stating that I wanted to pay it off and get it sorted and to send me info on how to pay aswell.
              This is what I eventually got the reply to (the attached letter in my previous post)

              I was told to address the letters to the fines officer, which I did.

              I am replying as there isn't much I can do until Tuesday.

              I just want to ask~

              Marston can't just break in and take stuff from my house? I have the notice on my window next to my front door removing their implied right of way but I read on another forum that bailiffs are being told to ignore this?

              I'm just so worried about losing our stuff, the majority of it was provided through a charity as we didn't have anything after being made homeless and anything else we have struggled to save up and buy .

              I also read somewhere warrants are only valid for a 180 days/6 or so months?Surely my warrant would have run out if it was issued way back in 2011 or do they just re-issue them? If I contacted my MP would she be able to help me?

              Just one other thing I found this Marston bailiff guy "Alex Bryant" (this is the name on all the letters etc) is actually Alessandro Bryant-Roggero and is a certificated bailiff altho he has never shown me or my partner ID or any proof of who he is.



              I really appreciate everyone's help, I just wish I could just go to the court and speak to someone!

                They certainly shouldn't unless they can prove deliberate and repeated obstruction but, unfortunately, that can mean almost anything.

                Correct. I'd suggest removing it as, not only is it worthless and of no effect, it may suggest that you are in the category of "won't pay" rather than "can't pay" and hence provide an incentive for forced entry.

                Most of your goods and chattels are probably exempt, though no bailiff will tell you that. A washing machine would probably be exempt, though a tumble drier might not be. Television sets, games machines and computers would not be, unless they genuinely belonged to someone else and had merely been loaned to you; the owner would need to make a Statutory Declaration in front of a Commissioner for Oaths (most solicitors will do this) wherein their title to the goods is asserted.

                It would have needed to have been re-issued but, as you've not seen the warrant, you've no idea when it was last issued.

                She should, if only by asking a question or two of the Ministry of Injustice.

                That would suggest he is using a false name on those documents which could be more than a little bit naughty.

                Do you know when and where he obtained his Bailiff's Certificate?

                  The entry says:

                  Alessandro Bryant-Roggero Peterborough Combined Court Centre 12/06/2012 11/06/2014 Marston Group
                  However all marston p/w I have has a stamped name/mob number and the stamped name is Alex Bryant, I only by chance put Bryant-Roggero into the search as one of marstons office people called him Mr Roggero

                  I have removed the notice.

                  I am going to try and ring the court on Tuesday if I can find a phone to borrow, to be honest I don't really know what to say to them I am more of a letter writer than a speaker
