Also to make things worse, I have been paying more a month than instructed! £160 rather than the £151. so now what!?

yes a bailiff came before xmas and we came to arrangement which i have stuck to apart from the once when i still made a payment but was half of what was owed that month, i then continued to keep paying and as i said the final payment was due to be tomorrow but lo and behold they turn up today and state that i have defaulted and added an extra £200 on top of what was left to pay.

Have you confirmed how much you actually owed with the Council? Also send off for a breakdown of the Bailiff fees, use Letter 1 from http://www.legalbeagles.info/forums/...Useful-Letters and send initially by email followed with a copy in the post.

Am sorry sparkie but I am lost , you were paying on the 1st of the month and yet you say the last payment is due tomorrow, do you not mean 1st April ?
How come you were paying £160 a month (should have been £151) and yet you say your last payment is £200 ?
just seems a little mixed up to me thats all.

Usual sort of response from the Council. Don't be surprised to find you have lots of extraneous charges the Bailiff has managed to inveigle. Most can be challenged and removed where it can be proved they either didn't happen or were unlawful.

well I was paying £160 to try and clear it quicker and the final payment was due on the 1st May but as i get paid on the 27th i normally pay on or around that date so its done.
oh and it would have been £200 to pay to finish the debt rather than £151 and then to pay £40 next month. i just wanted it cleared.

Ok so you actually owe PheoniX collections £191 that is the final amount to them, I would pay that in the usual way. Then I would pay the bailiff the charges he could apply for what he has done and let him try and justify and fight for the rest.

For what? The relevant legislation does not provide for this. Any charges not provided for by legislation are illegal and cannot be charged.

You have probably overpaid once the info from letter 1 adlluded to by ploddertom is in, I feel they may well owe you. All they are entitled to on top of the Lo owing to the council is £42.50 for a first and second visit fee, anything else without a levy would be unlawful.
