        And if he tries to bluff and bluster and actually remove goods, the police can be called to remove the numpty, if they are silly enough to believe any lies from the HCEO, then they will be guilty of offences also.

          If the OP has the Stay signed by the judge available and shows it to the police, the HCEO will go flying out of the door on the toe of some plod's boot.

            Ok folks found out from the court today that the stay has been set for a hearing around mid May time, the court worker could not give anymore details but said that all parties involved would be informed so that would apply to Marstons too,
            Do you think once they get wind of this that something may hit the fan?
            Also the wife is concered that they may come and still take the stock from our shop

              Sounds as if an Interim Stay has been set. Marstons would be very stupid to go against this as they could be hauled in front of the Judge to explain themselves.

                      If an interim stay is in place does that mean that it would be silly of me to pay anything else to marstons until the hearing?
                      i have had no letter from them regarding the £400 I paid them or if the offer I made each month is ok or not

                        A Stay whether an Interim or one put in place via a Hearing only prevents enforcement action & charges from taking place. If you had any type of agreement to make payment then in my view this should still continue. A lot may rest upon the terms listed in the Stay - did you also apply for a Variation? If so then wait until this is sorted.

                          The offer you made to the HCEO must be passed to the Judgment Creditor for them to agree or not - an answer should be received within 7 days. Again if you have also applied for a Variation this should be along the same lines of your offer of payment.
