    Hi all,

    First post onto this forum and looking for some advice,
    I have a ccj with a trade supplier that i am still struggling to pay and had a visit today from a Marstons hceo, he turned up at our shop at 15.30 while i wasnt there, he had a good look round upstairs and down then he got my daughter to sign a walking demand or something of that sort, when i returned i called him and he demanded that i pay up by 10.00am tomorrow morning or they will completely empty the stock from our shop (25k worth) to cover the now £1800 we owe, this would obviously finish our business as we would have nothing to sell so need some advice quick on what to do next?

        One might be inclined to shift the stock before the Marstons moron does, and to put a sign in the window declaring that it had been closed down because of XYZ Supplies plc.

          Would a stay and variation order application, the stay being the urgent first step, be an option in a commercial case?

            Just spoke to the bailiff again and he says a stay of execution would take too long to sort out and he would be back by monday with a truck to empty the shop, dont know if hes just calling my bluff but im feeling physically sick now

              Get onto a lawyer or your local law centre (link) today, without delay, to get a stay of execution.

                He is after money, bailiffs and HCEOs can lie, I would ask a legal professional PDQ and start the application. hopefully ploddertom will look in

                    You say your daughter signed a Walking Possession, what goods did he list on it exactly as written down? As for the stock in your shop is it all bought & paid for or is any on credit terms?

                        Daughter is 19 and works in the shop, he just wrote "all goods in shop" on walking possenssion, we have around £2k worth on credit as we mainly pay upfront for stock

                            Did you know about the original CCJ? Did you defend it at all or acknowledge the fact you received the documents? Were you adjudged "guilty" by Judgment by Default? Was the Judgment made as a Forthwith one?

                              Oh, excellent!

                              Close the shop for a few days (or maybe a fortnight) and remove all your current stock. Replace the stock with a load of second-hand and/or broken, cheap tat.

                              Let the oaf in to clear the shop of the rubbish. :rofl:
