  • Excel civil enforcement- lying through their teeth!!!

    hi, im new to all this but needed to vent!!!! lol
    about 4 weeks ago i had a mr williams turn up on my door step asking me if a mr james lived here?(my prtner) he showed no i ID didnt tell me where he was from, just handed me a white piece of paper and walked off. wen i then looked at the paper it read - "NOTICE OF REMOVAL". MORTIFIED WAS NOT THE WORD!!
    i then after ringing around and being told that i couldnt b spoken to found out it was from the balliff on behalf of the magistraight for my partner.

    i then proceed to tell EXCEL (whos customer service is second to none my i add!!)NOT!! that this was not mr james property, but mine. she then said we are aware of this it is stated as his c/o address and that he would have to speak to the balliff directly to sort it out. my partner gave "mr williams" permission to speak to me, he told me that we had ruffly 4 mnths to clear a debt of £1076!!! or they would come to my house and take my belongings to the tune of a grand. all i was recieving that the time was income support and child tax cred so bout 140 a week on averag!,at the time he wasnt living with me, so i questioned the levvy and was told in so many words "tuff im coming in one way or another"and that i would have to prove that all of the property was mine. so i hastliy agreed to a £60 per wk repayment plan, terrified that this dude was gunna come take all my stuff if nt. needless to say i didnt pay the balliff, although i did keep up the previos repayments to the courts( even tho the fine was my partners) bout 2 weeks later my good old friend came back with a red version of the notice, but this time all that was on it was a ref number and the amount du, no signature or ne thing. i sort avice with a good friend of mine who used to practice as a removals and reposetion barrister. she called him and he couldnt of been nicer until he informed my friend that he had now obtained a court warrant to gain entry to my house , so again panicing i arranged to for him to me and levvy.i dindt have a problem with him coming in the once as saww thea at i owned no where near enough to cover the debt, never mind the charges he cant take a thing. but hes coming tomoz hasnt , ring back, hasnt ansered ne calls and hasnt given me a time wen he mite b here. sort of ill see u wen i see u. advice!!!!

    so my prob is after shortin and d all the ****ty stuff about ive still got the feel my head is BOOM NE FEED BACK FREE lis fab!!! thanku

    Where in England or Wales has this happened? I would be inclined to ring the magistrates court that imposed the fine tomorrow morning and check out what this bailiff is saying. You should be aware that certificated bailiffs lie. If necessary, we will escalate the matter to the HMCTS Senior Enforcement Manager for your area and higher still if need be.

    Also, a bailiff cannot seize goods belonging to a third party, regardless of whether he has a magistrates court distress warrant. They can only seize goods belonging to the fine defaulter/debtor. I have brought to the attention of HMCTS Head of Enforcement Operations two separate incidents, involving Excel bailiffs whose behaviour and actions were unacceptable and, in one case, unlawful.

    Could you advise how much the fine is, please? Fees for collection of court fines are capped at £300 maximum (£85 Compliance Fee + £215 Enforcement Fee). Anything that exceeds £300 + fine should be challenged. What was the fine for and were your OH's means examined before the fine was imposed?

    It was a mistake letting the bailiff in.

      If the debtor is non resident, and it is just a care of address, then the bailiff can levy squat, in fact to pressure a third party into paying another persons debt is illegal. Do as bluebottle suggests. May be worth doing a Statutory Declaration at a solicitors about you owning all the property in the house, a bailiff ignores one of those at his peril,
