      Yes bluebottle, SLE is an autoimmune disease where the bodies healthy cells are attacked by the immune systems for reasons unknown. Im quite lucky as to date, i only have some of the symptoms....painful joints, extreme fatigue, skin rashes and headaches.
      I have dealt with B&S last year, when I was pregnant with my youngest baby. We had missed 2 months council tax and it ended up in the hands of B&S despite my pleas with the council. B&S came and levied everything, ...... We set up a payment arrangement and I told them of our circumstances. In pregnancy, secondary to the lupus, i have antiphospholipid antibody syndrome and I have to give myself daily blood thinning injections in my tummy. I only found out about these conditions after my first baby was still-born at full term in 2006. I explained how stressfull pregnancy was for me and that I didnt to have my goods levied but they took no notice.
      I made the agreed payments every week, except once when we paid a day late. The following week I went into premature labour with my baby and at the time, obviously, i didnt give B&S a 2nd thought. We ended up being 11 days late with payment and it wouldnt accept a payment online. I called them and explained in full and asked if i could pay over the phone and they said no, a bailiff would be out to collect payment in full (as i had defaulted) or remove my goods. I begged them, told them i had a new baby at home and they had levied my sofas but they didnt care. A bailiff arrived ( charging me £180.00 for the pleasure!!) and told me that if i didnt have full payment by 5pm that day he would b on my doorstep with a locksmith and a police officer. I was absolutely hysterical!! I didnt know then what i know now....i had just brought my new baby home and was terrified i would be sitting in an empty, cold room feeding her!! I borrowed the money and paid them off. I dont tell u all of this for any other reason than it just goes to show anyone who may read it what lying, manipulating scum they really are!!! They will stop at nothing.. i just wish i had found this site back then. Its a god send!! Thankyou so much 2 everybody for all of your help x

        This debacle gets worse and worse, the cretin bailiffs and council officials need a spell in prison.
        Send a letter baded closely on bluebottle's wording, your case should have been recalled from the bailiffs during the pregnancy, I would be minded to report the council and B&S to the HSE anyway.

        This council needs exposing for the heartless bartstewards they are, along with those vile retarded morons in Busted & Stupid. Which council is this? they need to be exposed. they are wholly liable for what has happened, your case should NOT be with bailiffs. If I were your local member, I would be at the door of the CEO, and Elected leader demanding action.

            Im just wondering.......................Bristow & Sutor bailiffs have been in my home before, for a previous debt, does this mean that they are now able 2 gain entry???? I havent let them in this time and i dont intend to but does the fact that they have entered my house,ever go against me?????

              I was tested for Lupus when they were investigating the pain, fatigue and breathlessness I was and am, to one extent or another, suffering. I have Fibromyalgia, which is not an auto-immune illness. With FMS, the body does not produce serotonin and noradrenaline in sufficient quantities and there is an absence of something called Substance P (they haven't found a name for it yet), which is involved in the way the body deals with pain impulses. On top of that, a NCS and EMG revealed damage to my motor nerves. Because I am opiate-intolerant and intolerant to NSAIDs (Non-Steroidal Anti-Inflammatory Drugs), there is nothing they can give me for the pain. So I can sympathise with you on the issue of pain.

                  No. Once a Liability Order is completely discharged, that is, the debt and bailiff fees are satisfied, the bailiffs have no power whatsoever. So if they claim they can force entry from the previous LO, the answer, very simply, is if they have not been permitted entry for the current LO they cannot force entry or demand entry. If they try to, you are entitled to use as much reasonable force as is necessary to stop them entering or remove them if they gain entry and refuse/fail to leave once asked to leave. This was confirmed by a criminal appeal at either Hove or Lewes Crown Court, before HHJ Brown, the most senior Circuit Judge on the South Eastern Criminal Circuit in December 2012.

                      If there is no valid levy of distress on this debt (and certainly if there is no current Walking Possession Agreement) then they have no right to force entry. They will probably try to argue otherwise, but remember...

                        See the draft letter I put together for Milly, CC. It mentions the LGO. In fact, I am wondering if they are grounds for going to the LGO, taking account of the local authority and B & S's actions on the previous occasion. The two instances are related. Speak to your MP, Milly, and see if the matter can be referred to the LGO without going through the usual charade. There may be a provision under the LGO's terms of reference which allow cases to be referred without going through the usual complaints procedure, in exceptional circumstances.

                            ...and tell them you will be contacting the media, also. That can often bring about a swift change of attitude.

                              Yes agreed bluebottle, this one has gone to far, media as in national press, like Daily Heil (Mail, grauniad (Guardian), and maybe even The Sun, as local press are often in the council's pocket due to advertising revenues.

                                Thankyou all. I will be kicking butt with it today!! I have asked my council both in this case and a previous one for help and they just didnt want to know. I called them last year, crying hysterically, heavily pregnant and ill and they just kept repeating the same old BS that once its in the hands of the Bailiffs there is nothing they can do. Luckily for me (and thanks to you people) im a bit wiser this time and wont be taking their cr*p!!
